Credit ratings ruined by fraudulent IVA's!!

A very long story cut short, in 2015 I applied for a joint IVA with my wife to Knightsbridge insolvency. They said creditors had rejected the proposal however an IVA could be made in just her name. I noticed in 2017 they had actually registered an IVA on my credit file and after an issue arose whilst trying to sell our house, we found out that my wifes IVA was invalid because within the IVA, out of 5 accounts, 4 were actually mine and one could not be confirmed so was written off. This means they registered an IVA on my file but one was never even created, and they created an IVA for my wife by using my actual credit accounts, not one account in her IVA was valid and in her name! this has caused Huge problems for us so we want to do something about it such as sue/claim I don't know what to do, who do we need to speak to? A financial lawyer?

  • Not sure what a financial lawyer would be, but your starting point would be to approach the creditors to get it fixed.
  • Sorry I should of confirmed, it is all fixed, I got a certificate of revocation issued for my wife and gotctge credit agencies to clear our reports

    Did you follow the advice given by National Debtline last year? What was the outcome?

  • In the end I tracked down the original I.P and after a bit of to and throwing he reluctantly issued a certificate of revocation which was then sent to all credit references agencies to get it removed. It took my 6 weeks to get the credit agencies to sort it out, they removed mine following a letter written, again by the original I. P.

    However the reason for the new thread is to find out who we should approach to help us create a case against the I.P/issuing company

    National Debtline suggested this course of action...
    If you are unhappy with your IVA provider then you can look into a formal complaint with them. This would go to the IVA company first of all, and if it remains unresolved to your satisfaction you can normally escalate the matter to their trade body and ultimately up to the Insolvency Service.

    Did you raise a formal complaint with the IVA provider?

  • No complaints have been made, knightsbridge insolvency have ceased trading it seems so I'm unsure how to contact them, personally I don't see how a complaint to them will help in any case

    That will be a no to contacting all 3 agencies then. If Knightsbridge Insolvency are no longer trading who/what are you going to sue?

    Are you just upset that you don't have anyone to sue?

    You asked the question over a year ago and have yet to follow up on all the advice given. What different advice do you expect to be given this time round and what's the point of people answering you if you're just going to ignore them?

    Then that is the end of the matter.

    You cannot sue an insolvent company, your issue was with them, when they went belly up, so did your chance of getting any compensation for your troubles.

    At best you would just become another creditor of theirs.
