Motorbike PCN charge

Hello,

Firstly I had read the newbies thread and much of it confused me.

I parked my motorbike at a private carpark that was signed and had a machine but I was only gone for 10mins and didnt think id get caught, anyways here I am with a £60 charge and I am unsure what to do.

The company is Linkparking.co.uk and it says on their site thats its a IPC operator.
I just need some help on what to do next.

The thread states that I should wait for a letter and then appeal it with the template in blue writing.

So I just copy and paste the text and send that off and I dont have to pay?
Could I not say that the ticket was stolen due to having a motorbike.

any advice would be greatly appreciated.

Im a little worried about the charge going to £100 and having bailiffs and whatnot at my door.

Many thanks.

Link will not just drop it. The easiest way to get it cancelled is to complain to the landowner. If it was a retail park one of the shops may cancel it.

The appeal letter lets them know you aren't an easy target who will just roll over. They will reject your appeal and further appeals to the IAS are somewhat futile. They reject them out of hand.

You will be bombarded with debt collectors letters. Don't worry about these. They are designed to be scary but can be ignored.

You must not ignore a Letter Before Claim or a claim form. Come back if you get one.
  • Thanks for your quick response,

What happens if/when I get a claim form?

What happens to the debt? I assume this will effect my credit rating?

    Thanks.

You need to read the Newbies thread again. If you still don't get it, read it again. All the information you need is in there so you need to read it until you do understand it. People here will help but you need to help yourself as well.

Your credit file will only be affected if you lose in court.

You will get a Letter Before Claim before a court claim is lodged. Read up about it and come back for further assistance if you get one.

Yeh, why not, an untruth to cover up after avoiding paying the required ticket price on the day. Perhaps before you do so, why not type this name into Google. Fiona Onasanya.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I am going to assume that the Claim Form came from the County Court Business Centre in Northampton. Please confirm.

With a Claim Issue Date of 5th June, you have until Monday 24th June to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox file linked from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.

Do the AoS today - as described above.

Having done the AoS, you have until 4pm on Monday 8th July 2019 to file your Defence.

That's two weeks away. Not long, but plenty of time to produce a perfect Defence. Don't leave it to the last minute.

When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

As a former bike rider, it is virtually unheard of for a bike to get a ticket. for the reason the OP has pointed out, there is no way to secure the ticket.
