To whom it may concern,

Due to not receiving a copy of the amended POC I wish to use my original Defence which I have given once more, with that said. If I had been given the opportunity to review the amended Defence my current decision may have altered.

There is no "amended defence" , because your decision is not to amend it

You are writing to a judge, so get your words right

If you had seen an amended POC from an amended claim, you may have amended your defence accordingly

Understand the differences, or fall on your own sword

Possibly the OP meant to say this: -

To whom it may concern,

Due to not receiving a copy of the amended Particulars of Claim (POC) I will use my original Defence, which I have submitted once more. However, if I had been given the opportunity to review the amended POC I might have been in a position to submit an amended defence.

Formal letters start Dear Sir, and end Yours faithfully.

Looks like they're going ahead with the court date. I was hoping they wouldn't pay the court fee and it be struck out. That's not the case they have paid it and are proceeding.

You need to write a Witness Statement and gather your evidence.

Look again at your Notice of Allocation. The Notice that gives the hearing date.

Is there not a paragraph something like:

Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than [ . . . ] [14 days before the hearing].

Might be on the back.

Those documents you intend to rely on are your Witness Statement and evidence.

You need to file and serve a Costs Schedule at the same time too.
