Advice on ex husbands entitlement please

    His solicitor can’t get any sense out of him children 12 and 15. The 60% balances out pension and 50% of house equity

    The house is valued at £170000 by three estate agents and a chartered surveyor he insisted upon. He still insists house worth £200000 and won’t budge.

    This is how I see it.

    He was an able bodied man, had accident, can't work, has a good looking wife (in his eyes) and is out at work and wifey has work, work mates/friends and the green-eyed monster sets in - wife is not cheating but hubby at home 24/7 and brain keeps on going around in a negative manner and feels wife is cheating resulting in controlling and arguments - wife is looking after children, house, work and husband but still gets abused - correctly or incorrectly hubby feels wife is cheating so p's off to mummy and daddy home - wife is generous gives/offer 60% (why more than 50% not sure) and hubby feels had done by won't be in a negotiating mood where he has lost his kids, home, job, life and wife. Therefore get the boiler repaired keep receipts and a 50/50 share as you have done nothing wrong. For his part the accident and woes afterwards was not his fault and his behaviour, sadly this happens to men and women that worked lost job through accident/illness and OH goes out and they get negative vibes, rightly or wrongly.

    You divorce him and apply for a financial order.

    Have you considered taking up writing fiction? Because that's quite a leap from the information given by the OP.

    It’s good that you’ve got a sensible and documented valuation at this point.

    It does sound like he’s going to drag it out and make it expensive though, have you got a good solicitor?

    The three valuations are worthless in his eyes. He needs to get his own valuation under the folwing headings:

    Quick sale
    Current market value
    Optimisitc valauation.

    His valautions may come in a lot higher than yours, then you need to retain evidence of simlar properties selling in your area.

    The other option is, ask him for the 40% of 200k and move. Even allowing for the stamp duty you will be miles ahead. I know he does not work but his parents could laon him the 78k, ie minus the solicitors dees, agent fees.

    Your ex appears to be seriously injured, emotionally. Do you get on with your in-laws as they could mediate?

    Alternatively, do you have someone on your side of the family or his that you and your ex trusts that can act as a go between?

    Even though I and several others have spent time & effort trying to help you here, IMO, the above link is the way forward and possibly some bits from I have said and some others as well.

    Please don't feel you need to update us op, hopefully you'll have some useful advice to act on but you have much more on your plate than letting us know what you decide.
