Faulty Mattress

I am also have an Issue with a New mattress I purchased from Land Of Beds in Wigan. cost £1160.00
A Sealy Platinum Hybrid Geltex Mattress King size. The label that is stitched to the mattress says "No need to Turn or Rotate so has NO handles either side of the mattressand is very heavy . My wife is disabled and the side she sleeps on has dipped and the Geltex has now mushroomed and is hanging over her side My side also has dipped as well. The "Engineer" they sent out from Fira came out. lay down on both sides and admitted it was dipped on both sides with a prominent ridge in the middle the proceeded to do what he called a "shakedown test" lifting it up on its side beating and pummeling it back to shape (I took that to be an acknowledgement of a fault) I asked him how often would that have to be done as i could surely not be expected to lift this on a regular basis he said it would be ok now ? We slept on it again that evening and when we got up the next morning it had gone back to the same state as what we had complained about. I rang the engineer that same morning to tell him it was not right and guess what no response.


I have involved the local Trading Standards Office who are trying to sort something out but Land Of Beds just told them today they arn't interested ?



Where do I go from here ?????


Does anybody know where I can get my own independent report from (i live in Cheshire)

    Land of Beds offer Interest Free Credit via V12 Retail Finance also arn't interested and the
    Trading Standards have spoken to the finance company and the way they operate and the small print they have NO liabilities ?

    Finance companies do have liability's, they have to offer S75 protection by law.


    They don't have to do anything until you prove breach of contract however. You need the expert report for this, the cost, if found in your favour, must also be refunded to you. I am not sure who could do this report however, maybe an upholsterer?


    If you can't find an expert then just go straight to the small claims court with photographs. The person that hears the case isn't stupid and they would expect a mattress costing over a grand to be better than 8 months use.
  • I was led to believe that S75 only works when a credit card is used ? I never used one because it was interest free and no deposit was needed ?
  • S75 applies whenever consumers get something on credit (over £100) and that credit wasn't given directly by the retailer themselves.

    Have you contacted Sealy to advise them of the problem?
    The mattress will probably have at least a 5 year guarantee and they might replace it without you needing to worry about haing to get an independent report carried out.
  • This mattress is now 8 months old but we complained 3 month ago so it was 5 months old when we started this process.

    Looks like Land of Beds and V12 Retail Finance have everything stitched up and look squeaky clean and
    are not interested once they have your money ?


    I wouldn't recommend either Companies to anybody !

    If the finance company won't accept your claim once you have evidence that the mattress is faulty then you can escalate your complaint to the Financial Ombudsman, who going on what we know so far ought to find for you and order them to pay up.
  • Yes I have Sealy is now part of Silentnight they said we have to go through the retailer ! Again the don't want to know ? They use FIRA for all their issues and unfortunately are Retailer biased.
    Their reports always state it's not a manufacturing fault.
    This I believe is common knowledge !

    I don't think the mattress being under warranty is in question.
    It's the fact that any warranty claim has to go through the supplying dealer that appears to be causing the problem.
    If the retailer has said that there isn't a problem and won't pass on a warranty claim to Sealy then it appears that the customer is screwed.

    It is with the retailer that the purchaser’s Contract of Sale exists and, consequently, Sealy cannot enter into any discussions with the purchaser until the retailer has inspected any alleged complaint and judged it justified or otherwise.
    On receipt of the retailer’s report, Sealy will take whatever action is necessary under the terms of this warranty.

    However, it's still possible that a Facebook post may get a result, something that it's certainly worth trying.
