Definitely something for me to bear in mind. I myself have never dealt with anything at all in the legal sense, hence why I don't want to confuse myself or over complicate my WS incase I find myself getting tangled and confused when questioned by the Judge.
Yes I saw that in CEC16's case (very funny and gave me HOPE), but I always think knowing my luck things will not go the way I anticipate....Bear in mind that it's the claimant who will have to see that you mean business , not Gladstone's , G will take instructions from their client , but don't think that G,s prepare all these cases and don't think they are getting paid a lot of money for doing so , it's not like an injury case
I am not convinced that they or DCBL or b w legal actually have trained solicitors going through each and every case
Bear in mind that you are consumed by your own 2 cases and are learning the tiniest aspects , G,s won't be doing the same and won't attend either, chances are they will send a legal beagle who isn't familiar with the case and only got the paperwork the day before , so is ill prepared
In the CEC16 case , a barrister was sent but still lost to a well prepared lay rep , semi retired school teacher , lol , happy days0 -

We have seen many nervous people like you win at court , some half a dozen or more in the last 10 days alone on here , most of them were like you , only one lost to my knowledge last week0 -

Sorry to drone on and I am sure you have answered these questions thousands of times but can anyone please advise on the following:
- What type of folder do I send my WS in, is it just an ordinary ring binder, nothing special?
- Do I need to ref POFA schedule 4?
- When printing off cases (eg Beavis) do I need the full document or just highlight the relevant info and only print those parts?
- What about previous PCN's? In the past I have stupidly paid many a PCN to the Claimant before I was made aware of this scam. I even once paid £140 on the spot to remove a clamp after I had left my car without a permit for around 10 minutes whilst I was taking my baby's car seat into my home. Should I mention these past issues in my WS? Would I be able to claim a refund of these from the Claimant if I am successful in Court?
- When do I send my WS to the Court and Claimant? Do I need to wait until the claimant has paid the court fee due 4 weeks before the court date or send it in now?
- Do I answer any statements posed in the Claimants WS (if received before I send mine) in MY WS, or just wait to hash it out in Court?

A hard cover ring binder to keep your documents safe from damage will do. I believe POFA is law, Beavis is well known (or should be to judges) but, and maybe this is just me, I would submit the relevant sections. You could search the forum to see what others have done or been advised. I would say that you can only write in your WS anything that is relevant to this case. You can wait for the claimant to pay and/or submit their WS but DO NOT miss your deadline. If you do get the chance, you can pull apart their WS.0

The previous payments and cases are not relevant and no you cannot get reimbursement in this case , you would have to issue your own court claim
Concentrate on this case , don't get distracted , don't print the laws or the Beavis case , just relevant parts , follow the advice in the previous reply

I do have the tendency to get distracted and caught up, hence why I am so overwhelmed by this process. Thank you for clearing this up for me, will tackle that road (previous PCN's) if and when I ever get to it.

Don't take this the wrong way but I cannot see you taking them to court over the previous issues , not with the amount of work and focus you would have to put in , it takes a strong willed and focused person0 -

You are 100% right, I wont have the willpower to even begin pursuing the previous ones, it was just a question to put out there out of curiosity more so.
The trial date is the 4th March, the claimant has until the 4th Feb 4pm to pay the trial fee of £80.00 (lol this makes me happy!) HOWEVER it doesn't say when I need to submit my WS, will I receive another letter? This one is headed "Notice of Trial date".Correct , providing you don't let the deadline expire , meaning you might not get theirs in time

You should not be getting any more letters (unless the claimant fails to pay the trial fee) so I say again DO NOT miss your deadline or else I fear you will get one more letter - a judgment in default!0
