Hi all,
As I said I'd report back when I heard back from POPLA.
It's good news.
Thank you for submitting your parking charge Appeal to POPLA.
An Appeal has been opened with the reference *********..
Britannia Parking Group have told us they do not wish to contest the Appeal. This means that your Appeal is successful and you do not need to pay the parking charge.
Yours sincerely
POPLA Team
When I originally received a PCN as RK I had no idea as to how to fight back. I found this website and was initially overwhelmed with how much information there appeared to be. I felt I needed to rush the process and appeal straight away; my advice to you is don't. Calm down. Take your time. Get a cup of tea, sit down and read the NEWBIES thread. After you've read it, read it again. Then once more. It will start to make sense and you'll then be equipped to fight back properly.
Without the help of this website I wouldn't have been able to appeal in the way I did, so for every person that has contributed thank you. You're doing amazing job and helping lots of people.0 -
Well done Jakeh! Result!!!0

Great outcome Jakeh and great advice in your post above, particularly relevant to newbies who aren't wanting to put in the effort, but don't want to pay, yet expect a good fairy to come along and do it all for them.
Effort = results. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Proves that Britannia were trying to scam you in the first place.
Britannia are just another scammer approved by the BPA
At least you won't be hearing from the copycat Kray Twins bunch

Bear in mind too, that you don't have a legal obligation to show your identifying data (number-plate) to a parking firm camera, at all. Who says you do? No-one.
If filming of a documentary was taking place in your High Street and they were encouraging background shoppers to accept being filmed, and you didn't want to, then hiding your face under a hood as you walked past, wouldn't be illegal would it?
Why do people think they have to drive in/out and show their VRN to a camera?
If everyone covered their number-plate in ANPR car parks, the likes of Britannia and Parking Eye would curl up and die. There is no legal obligation to 'accept' the contract.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Very true! An interesting point to consider, but it doesn't count in case as the driver insists that they had no idea they were actually in a car park due to poor, inadequate signage and lighting...

Just a further update.
I am still in contact with my local MP (The Deep will be proud!) who seems to have actually taken an interest. They have raised a complaint with the BPA to investigate the operation BP are running on this site. Whether it goes anywhere or not I feel obligated to pursue this to the bitter end.0 -
Nice one, every action like that is a nail in the coffin of the industry.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
