speeding fine

  • I can't find the sample letter, but I have come access http://www.members.lycos.co.uk/maxboost/docs/saveyourdrivinglicence.pdf which has some interesting points.

  • Look at the back of the camera. If the vents are closed (the two small circles are grey) theres no camera in, but it will still flash. If the vents are open (the circles are black there is a camera)then you will be getting a Notice of Inpending Presecution or whatever its called.

If you do get a NIP I am sure you can appeal by sending in a letter as the law states you have to be cautioned before you can be prosecuted or something like that. Because you have not been told you 'have the right to remain silent', etc before you are sent the summons you can't be prosecuted. I had a sample letter as you have to be very specific about this. I will try and find it. If the letter fails you can still pay the fine as your letter will state 'I trust that my two weeks notice to pay the fine will start once I get my reply to this letter'.

    Hope this helps

The whole point of the NIP is a fixed penalty and fine gets paid without having to go to court. You have the right to put your case before a judge, citing such points as above. If you win then great, if you lose you can add £35 court costs and a days lost wages on top of the fine.

I have historically taken a choice to pay the £60 and that's the end of the matter. SP points make little or no difference to insurance premiums.

Take said, the odds on being nicked / caught at 34 in a 30 are minimal, as the code of practice is 10% + 2mph (35mph)

    Good luck :)

    Hi chiefs

Assuming you have not yet had a letter to inform you that you was speeding, which side of the road was the camera. If it was on the other side of the road, you may not get a letter, which I believe must arrive within fourteen days.

As someone else has already pointed out, if the camera was on your side of the road it must flash twice. It is the distance that the car has travelled from the first photo to the second photo that is used to calculate your speed.

Again as already mentioned, 3 points on your licence will have no effect on the cost of your insurance. However, if it bothers you that much and you have been caught speeding, pay for the course and then you will not have the points.

Either way invest in a snooper and never miss a fixed speed camera. I bought mine a few years ago and it cost me a lot more then £100. You can also pay an extra £100 and download updates for the rest of your life. I had to pay £5.99 a month for my updates.

Anyhow I will keep my fingers crossed for you.

Sorry, but this is not true, the law states the first NIP must be posted to the registered owner within 14 days (i.e. dated within 14 days of the offence). There is no requirement for it to be received by you within those 14 days!!

Just thought you should know for future reference.

How do I know this? I got an NIP at the end of April for speeding in January  ! I was in my husband's car which he gets through the motability scheme. The 1st NIP was sent to motability, who then sent it back to the police, the 2nd was sent to me dated 27th April!!! Obviously it was my fault for speeding in the first place, but a bit of a shocker when it arrives 4 months after you've been
    flashed:eek:

Was it 34 indicated on your speedo? If so then that'd usually not even by a true 30mph. I'd wait and see if a NIP arrives.

Indeed - it must be sent to the register keeper within 14 days, after that they have up to 6 months to lay the case with a court...

Sorry bagpuss fan, the above is incorrect, your case falls under a clause for company cars, hired vehicles etc which gives the police more time to investigate who was driving at the time the offence was committed.

    Take a look at:- http://www.speed-trap.co.uk/FAQ/FAQ.htm

The police have 14 days to send the NIP & they are allowed a few days grace to allow for the letter being delayed in the post. If the NIP is not delivered until 17 days or more then it becomes invalid.

Several times I have read advice in the press saying that an NIP received after the time limit expires should be returned, marked ''Out Of Time''.

I got caught just before the last Postal Strike.

I was keeping everything crossed that it wouldnt arrive within the 14 days but despite there being no postmen about, the £$*kin thing still landed on my doormat on day 11.

Perhaps a local bobby popped round.
