OK, I now have a much clearer picture.
With a Claim Service Date of 12th December you have until Thursday 27th December to do the Acknowledgement of Service, but there is nothing to be gained by delaying it.
Having done the AoS, you then have until 4pm on Wednesday 9th January 2019 to file your Defence.
That's four weeks. Plenty of time to produce a perfect Defence.
When you are happy with the content, your Defence should be filed via email as suggested here:-
Print your Defence.
- Sign it and date it.
- Scan the signed document back in and save it as a pdf.
- Send that pdf as an email attachment to ccmcce-filing@justice.gov.uk
- Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
- Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
- Wait for your DQ from the CCMCC, or download one from the internet, and then re-read post #2 of [URL="https://forums.moneysavingexpert.com/discussion/4816822NEWBIES FAQ sticky thread[/URL] to find out exactly what to do with it.
0 - Sign it and date it.

Further to Redx's post #9 above, you might like to read this short extract from The MSE Forum Guide - Frequently Asked Questions & Rules:Q. How can I change my username?
A. In most circumstances, this is not permitted.
The only reason we will change your username is if it puts your privacy at risk. This usually means you've inadvertently registered using your name, email address or something that gives away your identity within your username.
If you fall into this category, email forumteam@moneysavingexpert.com and request that it is changed, giving three alternative usernames in order of preference.0 -
That’s great, thank you both for your advice. I will draft something up this week and put it up (taking extra care to remove personal info!) for your scrutiny

Saints1321, welcome to the forum.Saints1321 wrote: »Hi all, new here but having read a few of the threads It all seems like interesting stuff! I looked at the BPA AOS for my own appeal last year however grave periods only apply where parking is encouraged/welcomed. What do the ppc say the terms of parking are / is it a car park or members only type site?
However 'grave' your 'periods' are, you would be well advised to start a new thread.
Trying to deal with two different issues for two different people on a single thread can only lead to confusion.
Thanks for your understanding.0 -
I think you are mistaken.Saints1321 wrote: »...as BPA AOS grace periods only apply where parking is encouraged/welcomed... and do not apply at member only car parks like social clubs or gyms.
The BPA CoP says:
I would suggest that eight minutes is a 'reasonable grace period' to allow for parking, finding a sign, reading the sign and making a decision on whether to stay or not.13.1 If a driver is parking without your permission, or at locations where parking is not normally permitted they must have the chance to read the terms and conditions before they enter into the ‘parking contract’ with you. If, having had that opportunity, they decide not to park but choose to leave the car park, you must provide them with a reasonable grace period to leave, as they will not be bound by your parking contract.0 -
I'm only offering an opinion.
That's all.
You haven't said when your parking incidents took place, but condition 13 of the BPA CoP changed significantly at the beginning of this year.0 -
Just a minute...Saints1321 wrote: »...rather than spouting views like the ppc will use the DirQ to put you under pressure which is a falsehood.
You accuse me of spreading misinformation, but you seem to be speaking with some authority when you say that.
How can you say with certainty that me mentioning that PPCs send out DQs early to put pressure on the Defendant is a falsehood?
Which PPC do you work for?
If you don't have inside knowledge then your 'opinion' is worth no more than mine.0 -
The POC states the parking is for Vets 4 Pets customers only, and that the vehicle registration must be recorded within the vets practice. However this car park previously had no restrictions in place. the vets practice share a building with a Subway sandwhich shop and only a portion of the spaces were sign posted as Vets 4 Pets only, all of the spaces however have small signs put up by PP indicating private property. I would also note this wasn’t easily seen by the driver as it was night time with no street lamp in the immediate vicinity0
-
Yep POC states the car park is owned by V4P, photos were provided to POPLA by PP of all signage in the car park when originally installed. as to wether the signage is noticeable with head lights I would argue they are inadequate, however the POPLA assessor didn’t not agree with me.0
-
Sorry that was a mistake in the sentence above ** the POPLA assessor did NOT agree with me**.
No, the driver entered the car park and did not make use of any local facilities.0
