My car was hit while parked, I was not present but the guy that hit my car came and told me it had happened so fair play to him.
He was using a company vehicle, now his boss is saying that his insurance can't be claimed against and I need to claim off the drivers own personal insurance. I don't think the driver has the appropriate cover himself.
Also they say I need independant witnesses, 3 of my neighbour saw the accident take place. These people know who I am and the other driver. Only my name and I live near them it's not as if we are friends. How little does someone need to know you to be "independant" ?

Why do you need any witnesses as the 'guy came over and told you he had done it'?


Just claim off the guy and let him deal with his insurer be that company or otherwise; its not your job to sort out his insurance issues.

it seems very odd for a company policy to not include third party cover - i thought third party cover was mandatory

Then contact the Insurers, they are liable even if he was not covered by the policy

Even if he won't give his insurance details, the claim is against him anyway. Up to him if he passes it to his insurance company. He's as liable as the driver.

The company admits they own the vehicle so they are legally liable, any in-house rules they have about insurance/accident claims are nothing to do with you. Contact your own insurer they will sort it out. It is a condition of your own insurance that you inform them of the accident even if you do not make a claim on them but in this case I think it will be to your benefit to do so.
