    Don't forget to play nicely and in your email to BW Legal, tell them the Judge at the current court (xxxxxxx) is currently considering this week, a Without Notice request to move the hearing to xxxxxx court because you are moving house before the hearing date and as such, this is not convenient as it is no longer your local court and you are aware that neither this Claimant nor BW Legal attend cases themselves, so a change of court and a new hearing at xxxxx instead will not in any way affect their legal rep's ability to attend.

    Remind them that their first duty is to the court and not their client, in any case.

    DO NOT ask for their agreement nor even give them the time of day to object, just say the above, as a fait accompli, so they can't say you ambushed them!

    Always check with the court that the hearing has been vacated, assume it's still live unless you hear different from the court

    This was so predictable once you put up a solid defence and were not wavering. It is the route BWL roboclaims go when they are faced up to by a determined defendant.

    It is appalling that defendants have to jump through every single hoop BWL put in their way, or face the very real risk of a judgment in default against them with potentially serious consequences for their credit rating. Ambushed with little choice. Months of work and worry.

    Please bring this pernicious process to the notice of your MP. It has to stop, and only the Government can tackle it effectively.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Hi, I've been following your thread, delighted for you that they have dropped the case!

    Am I right in thinking they never saw/read your defence or witness statement? You dropped it at the court only but never emailed it to BW Legal?

    Is that correct?

    BWLegal are unreal with their daft claims.

    Still trying to prove themselves in the parking scam ???

    With Boris stating in the House that we, the public, are the boss, the time is right to start complaining to his new Justice Secretary, Robert Buckland, about the antics of these dodgy legals and their timewasting activities in the County Court
  • Yes I believe they never saw my WS or evidence as I dropped it to court on Tuesday 23rd and only emailed them over the WS etc on Wednesday 24th so if we were to go with their letter dated the 23rd then I presume they wouldn't have read the WS or evidence?

    ask the court to make it a costs hearing and claim your costs !!!

    make sure you write to the judge with your costs schedule at the same time as asking for it to be this costs hearing - get your own back
