How can I reliably record my vehicle being elsewhere?

Sounds like a strange thread title.


I'm getting a lot of PCNs from a parking company where I am having to (successfully) appeal each one. The problem is that I have to access the parking companies site, and drive through it to another private site. The parking companies site has another camera which is supposed to pick up me leaving their site for the private site. Quite clearly it does not work or their need for money is greater.



I'm thinking that taking a mobile phone picture of my vehicle on the private site may not work - although there would be date time and GPS details. I could ask the private site for CCTV images of my parked car but that is hassle, they could refuse, or the video could be overwritten.


I have complained to the supermarket and parking company both of whom are disinterested and issue standard template responses.

    About 1 in 3 weekly visits produce a NTK - so around 25 since Sept 2017


    PPC is Athena.


    I asked my MP to support the Parking Bill which she has done. She even took up my case with Athena and the supermarket and she was amazed how obstructive they were and failed to reply to her questions - only using their standard templates.

    Sounds like there is an easement/private right of way through the car park to the secondary private site, is this correct?


    Do you have a location of this site/car park?


    I'm not 100% upto date on rights of way issues ( although i have been on a walk with a militant ramblers/footpaths group who were armed with wire cutters/adjustable spanners etc to clear unlawful obstructions)

    You may have a right to pass/re-pass along the route without let or hindrance, the ANPR equipment is causing you and others a hindrance to your right to pass/re-pass.
    You should be looking at the following action:


    Complain to the supermarket manager, that his/her ANPR equipment is causing you an issue with your right to pass/re-pass, and you want it de-activated with immediate effect, the manager will be jointly and severally liable for the actions of his/her agents.
    If they offer to add your vehicles reg number to a white list, tell them this is unacceptable as you may be in a different vehicle ( ie a hire car)
    If you do find a hire car ( ie one provided after an accident/breakdown) there is a good chance the hire company may pay the PPC and then charge you( plus its own admin fee)

    You should also tell the store manager that any accessing by his/her agents ( the PPC) of your personal data to be used to chase parking charges will be seen as harassment, and a breach of the GDPR regulations ( accessing your data with no just cause - as your vehicle wasnt parked and the automated systems are faulty), and as such you may need to take action on that side of things, remidning the store manager that He/her may be personally liable.




    There are plenty of things to go on, but in a nutshell, you shouldn't be appealing each parking charge notice and wasting your time, this needs to stop - again where is this location?

    If the supermarket are being obstructive, and you have a right to pass throughthe car park, raise merry hell, and hit them.
    Parking companies are scum, and those that back them up are no better why treat them with respect, Do unto others as you would have them do unto you.

    If that is the only route to the "private site" have you spoken to the owners/occupiers of that site as surely you're not the only one who's been caught out like this? Perhaps they could get the tickets cancelled for you and your number plate 'white listed'?
  • Apologies if I missed it in other contributions here.

    Other ways to track your vehicle would include getting a dashcam as the timestamp and GPS information will prove your point or alternatively, telemetry as part of vehicle insurance. I have it for mine and the journey data is linked to your vehicle registration and policy.

    Report Athena/the supermarket to trading standards and the ICO. Particularly if Athena have systems that through their own inadequacy, omit capturing information that leads to what in are fraudulent notices.

    Not forgetting your vehicle keeper data is being requested from the DVLA every time (or should be) so complain to the DVLA also as these frivolous PCNs would be a breach of the KADOE contract with the DVLA.

    Worse comes to worst there's always the public option, some national newspapers have a spotlight on this given the rampant predatory nature of the industry.

    SAR Athena for the ANPR footage. Similarly if you are driving into another car park with ANPR or CCTV hit them with a SAR as well, that should easily prove it


    If you have had that many invoices I would seriously be looking for Compo under DPA

    Put them on notice if you receive another invoice you will sue them for distress under DPA £750 sounds like a nice round figure

    A "cease and desist" letter might givem the cause to reflect. You can download one free on the internet.

    The parking company most certainly is NOT disinterested. Look it up. The supermarket would like to be disinterested, but cannot be. They are probably both uninterested, though.
