Compensation from gas being capped

    I hope someone can give me a little advice. Earlier this year I had to miss my annual gas safety check from my housing association. I had an appointment at hospital and made arrangements to reschedule with my housing manager. On the day of my appointment I was informed en-route to hospital that my gas was being capped.
    It was 5 days before it was returned to service. I am considered to be 'vulnerable' - I have a 20% disability as well as fibromyalgia. I was also being treated for a serious infection at the time.
    Long story short it was office politics and poor communication that led to my capping - they have admitted so. Today I was offered £125 in compensation. I really don't know what to think of it as an offer. I don't know if it is generous or insulting - I just see it as a 'pointless amount'. The offer was made "for the inconvenience and in particular to your health"

    My logic is that to have had heat and bathroom facilities I would have had to book into a hotel and that should be the minimum they look at. Am I wrong? Help please.

    If your actual losses are less than £125 it's fair

    If your actual losses are more than £125 it's not fair
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    From experience its very unlikely the landlord agreed to turn the gas off as its illegal for them to do so. HAs have evicted tenants for refusing the safety check as sometimes its their only option. Was the check overdue, many are done before the 12 months to avoid being done too late. Gas servicing is often contracted out and for the individuals doing the work there is often no-one home for the appointments. The more aggressive or cocky will turn the gas off or cap the supply to force access. HAs do not support them doing this hence the compensation offer.

    £125 is better than nothing. Push for more if you think you can justify it.

    If you consider £125 to be "pointless" and you cannot quantify your actual loss (not a theoretical one as if you'd booked into a hotel if you didn't) then you are legally entitled to inform them you do not wish to take up their generous offer.

    Up here if you miss your gas safety check it then they’ll cap your gas so it doesn’t go over the 12 months. They don’t do uncapping out of hours so I’ve had irate customers angry that they’ve to wait a whole weekend. We do provide temporary heaters so people aren’t left in the cold. Not having hot water doesn’t count as an emergency repair as it’s possible to boil a kettle and have a stand up wash if required.

    Are you, we or they aware that cutting off a tenants gas supply is harassment.

    Who are you referring to, a private letting agency?
  • Cutting if gas is only harassment if the circumstances are unreasonable. Think there's a phrase in the act going further than that.
