Appeal sent but not received

I have a problem that i cannot find anything stating the problem. my PCN is with Parking eye which i had sent all my information of on the 9th of November which the deadline was the 14th this was sent first class non-recorded (silly mistake i know). To which i have received a CCJ. To my luck i had taken pictures of all the documentation before it was sent which features Geo tagged location and time data. what should i do?

Has anyone else had a similar problem?

    To which i have received a CCJ.
    How much did the Judge award them in costs? By when has the court ordered you to pay this? If you've missed the deadline from the court, you will need to risk £255 to try to get it set aside, or your credit rating might be trashed.

    You seem very well organised, but, have you googled CCJ? Have you read the stickies/FAQs? I rather expect that you have done neither.
    You never know how far you can go until you go too far.

    I have read through a lot of the stickies but i could not find anything stating something along these lines. The cost that they are stating is £197 but one thing that i am not understanding is that on my original court appeal letter and documentation it states that i should be sending all paper work to parking eye which does not seem logical. The deadline date is the end of December.

    Virtually all the information you need to deal with this matter is here. All you need to do is roll up your sleeves and look for it.

    Accuracy is a sine qua non in these matters, wjhich could end up in court. You do not have a CCJ, why did you tell us you did.
    You never know how far you can go until you go too far.

    You have not replied to the claim form
    It is therefore ordered that you must pay the claiment £100 for dept {and intrest to date of judgement]
    and £97 for costs [Less £0 you have already paid]

    at the top of the letter it states Judgement for Claimant ( in default )

    ahh , so your sent the CLAIM form to parking eye ?



    easy fix , rig them up and ask them to pop it in a passing Delorean , when you get it back , send it to the address it was supposed to be sent to

    From the little information you're giving here, you look to have screwed this up. The process you should have followed is detailed in the NEWBIES FAQ sticky, post #2, including a step-by-step guide to how to defend the original claim (you seem to be well past that point now).

    The choices you seem to have (based on the limited information you've given) are:

    1. If the deadline given to you by the court to pay this hasn't expired, pay the full amount to PE in order to clear the debt without any detrimental affect on your credit rating.

    2. Risk £255 in applying for a set aside, using the reasons you've given above for not properly defending this. You'll need to persuade a Judge that the reasons are good (not much chance in my view). You'll need to have a good defence lined up to defend the PE Claim and win that at court. Even if initially set aside, subsequently losing the case will see you having to pay PE their £197 and your £255 is lost. Even if you were to win against PE, your £255 would seem to be unrecoverable.

    3. Ignore everything, but your credit rating is trashed for 6 years (may not be a problem for you, but if you want a loan, mortgage, even a mobile phone contract they will be difficult, sometimes employment can be affected). PE might still decide to enforce the judgment, at which stage you might be getting a knock on your door at 5:30am.
