How much did the Judge award in Antandann's case out of interest?
I was really hoping you would look, as I gave you the member's name.
That's the best use of researching the forum...!

Hands up though, I put a capital letter by mistake, the poster was antandann

Sorry I didn't know he was a forum member, I types in ''Antandann's case'' in google and nice looking ladies popped up lol.

I will search the forum instead.

I've been going through the newbies thread and following it through.

    Thanks.

My case is at court stage and the total is around £180.00 plus a small amount of interest. I am hoping that even if I lose i should be able to lose £60.00 debt collection fees (which the PPC does not pay) and some interest which means not much more than the post appeal £100.00.

Going to court is a lottery but the PPC in your case has not been able to provide accurate evidence that their machine was working on the day and you have accurate evidence that is was not. That should be enough to convince a judge but as I have already said it's a lottery and judge's can be a bit random.

As this is a Station Car park and your car was likely to be parked for a number of hours you would hardly turn up without the means to pay.

Put up a decent defence and I suspect this will go nowhere near court. NCP, previously extremely court-shy since their eye watering defeat in the James Mahook case*, have been suckered into the BWL roboclaim strategy of heavy threatening of court proceedings and forcing people to jump through loads of hoops in order to soften them up into opening their wallets/purses.

We have yet to see a case, some 6 months in to the BWL onslaught, of a fully defended NCP case hitting a courtroom.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I notice from your post on another thread that you are spending £1200 per year on parking in this car park. Over five years that is £6000. I would reply to their next letter and ask them if it is worth losing that sum in order to chase a claim that has little chance of succeeding at court.
BTW. I would never park there again.

I've stopped parking there now because of this and park in a shopping centre which isn't managed by NCP. I'm also paying an extra £2 a day, but I claim it all back through expenses from work so nothing to lose apart from the fine.
