POPLA Complaint - Rant

Two months ago, I received a parking fine from NCP for non payment at a car park (Newbury Park Stn).

The reason for non-payment on this particular day was the ticket machine was not working so I took a picture of the machine in it's dead state and left.

After a couple weeks, I received a PCN through the post to which I appealed on the basis the ticket machine was not working.

My appeal was rejected, so I took my case to POPLA, now this is where it goes down hill:mad:.

After submitting my appeal to POPLA, they respond back with an evidence pack submitted by NCP.

Whilst looking through the evidence pack, it was clear the parking company were making up all sorts of things, but more importantly they provided photos of a completely different car park to the one that I was actually parked in.

Photos of the signs they provided were also out of date as the daily charges on the photos were less then they actually are.

I then responded back to POPLA (via email) with my comment against their evidence pack to which they acknowledged.
This was around 5 weeks ago.

Last Thursday I received the decision letter from POPLA which went against me :mad:. At this point I was :mad:.

After going through the decision letter, it was clearly obvious the adjudicator did not review my follow up response to the Evidence pack provided by NCP, as the letter made no reference to the fact the parking company provided wrong photos.

I then called up POPLA who basically said, mistakes can happen and I should follow it up with a complaint :mad:

I got 28 days to pay £100 but not sure if I should just pay and move on or if there is anything else I can do, as I don't want to give up £100 that easily.

    If not, why not?

    Yes, PoPLA do make mistakes, but we have seen them corrected sometimes.

    Mistakes are not an option for POPLA ????
    They do have assessors who frankly are as useless as a worn out toothbrush ..... I think that applies to most of them.

    So issue your complaint to POPLA and point out the fabrications of NCP

    Take it easy, a real judge will see through NCP and make POPLA look stupid

    Of course you shouldn't pay a scammer. PoPLA decisions are not binding on the motorist.

    As above, complain to PoPLA. I think you should also complain to the BPA, DVLA, and your MP about this unregulated scam.
    You have proof that a *cough* mistake was made and then ignored by the allegedly independent appeals system.

    NCP now know they have made a mistake and should cancel as well as deleting your personal data. If they don't, then in my opinion they are trying to obtain monies by deception.

    I would complain to POPLA. Some of the decisions recently have been shocking. This needs to picked up by POPLA.

    You also need to complain to your MP. Parliament is looking closely at the failings of the parking industry currently.

    Even if POPLA remains insistent they are correct you still don't need to pay. You say this was at a station? If so they may be unwilling to chance their arm in court. There is a strong chance byelaws apply and they won't want to risk a decision against them. It could open a can of worms for them.

    Even if they do launch a claim from what you say their evidence is rather laughable anyway.

    Newbury Park Station is a London Underground station.

    I recall a FOI request confirmed that all LUL station car parks are subject to byelaws.

    But I suppose if it wasn't raised in any POPLA appeal then they wouldn't consider it.

    That's right.

    But the point now being made is that the threat of any legal action cannot be taken by the PPC. And even if legal action were possible, it times out after six months.
