Hi
is it possible for someone to send me a link to the correct template for appealing a PCN . I've looked but I can't find it. Please send a link.
Will I need to edit it?
Thanks:(0 -
I never understand why OPs are recommended to use a generic appeal if they are an ANPR and can prove, via dates and date on NtK that it was sent out too late for the 14 day window.
If you are 100% sure that they failed this, then search this forum for a similar case, quote the relevant section from POFA and go on a single point appeal.0 -
Out of interest, what date was on the NtK you received, and when did you ACTUALLY receive it? POFA says it's presumed* delivered on the 2nd business day after posting. But I recently received on that was received 4 days after, so they either pre-dated it or sent it 2nd class. Had they sent it on the day it was dated, POFA assumes it was received in time. However, because it wasn't received for 4 days it was outside the 14 day time limit. So I have to prove I didn't receive it 2 days earlier. The envelope doesn't help as it has no date of postage nor any indication of whether it was sent 1st or 2nd.
*the POFA presumption is rebuttableAlthough a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users.
