highview parking charge help please

New on here. been reading other peoples posts and don't believe it is possible to be charged. . Any help would be gratefully appreciated. The driver parked at the local branch of Tescos the keeper received a letter from highview parking on Saturday with a charge notice saying that the vehicle was parked for over 5 hours which is in excess of the maximum stay time as clearly signposted throughout the site. The notice requests a payment of £70 or a reduced sum payment of £42 if payment is received within 14 days ie. before 10/12/2018. Is it possible that the charge can be overturned because it wasn't received within 14 days of the specified notice period? Also the signs notifying customers of the highview parking charges do not exist in the underground section of this car park...half of its got it and half of it hasn't and there's none by the entrance or the exit.

They have six months from the event to send a PCN, so it remains valid.
Send the already written for you blue text template appeal found in post #1 of the NEWBIES FAQ sticky thread.
Send it without change - no additions or alterations necessary.
Send it as the keeper.
At the same time complain to Tesco.
Now, before doing that, edit your post to remove clues to the driver's identity.
It was the driver who parked and it was the keeper who received the PCN through the post.
There is no place for the word 'I' when describing events on the day.0 -
As above, please edit your post before you do anything else. Only ever refer to The Driver and The Keeper, who are two different people.

Appeal to PoPLA and win on non PoFA compliance, with inadequate signage as a backup.

It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.
All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0 -

You're nowhere near POPLA. You need to use the blue text initial appeal from the NEWBIES FAQ sticky, post #1 to appeal to HV.
Use their online appeals portal, but be careful of the crafty drop down box which defaults to 'I was the driver' - check that it hasn't defaulted as your last action before taking a screenshot, and pressing the 'Submit' button.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
