Driver reversed into my stationary vehicle

Not too long ago I was stationary at traffic lights and later reversed into by a vehicle in front of me. The driver claimed that they though they were in first gear but it was reverse and that’s why the driver hit the front of my vehicle. My insurer has obtained a witness statement from an independent witness who provided an account of the incident and clearly stated that I was stationary and not at fault. On scene this driver apologised on number of occasions and said that it’s their fault. This driver is now trying to shift the blame On me, saying I hit their rear. This is so stressful for me as I’ve never had an accident before and have never been in a siatuation where someone made false allegations against me. My insurer is standing beside me in fighting this but there are offers of 50:50 being made, which I refused on the basis that I was not at any fault. Does anyone have similar experience? Or advice? Thank you

    My advice would be to buy a dashcam so that if you're ever in an accident in the future (although i hope not) then you will have more protection against dishonest people's claims.

    In the meantime you'll need to let the insurance companies battle it out and hopefully it will go in your favour with the independent witness.

  • If you have provided a genuinely independent witness statement to your insurer, stand your ground and let the insurer deal with it.

    As above, no need to be stressed just stick to your guns and let your insurer deal with it. You have witnesses so it should be pretty straightforward. I also agree with point about getting a dashcam for the future, these are a godsend in situations like this.
  • Thanks everyone, I do now have a dashcam and it does put my mind at rest, somewhat at least, as I now know how horribly dishonest some people can be.
