Scammed by gambling website - is chargeback possible

    The original payment is likely to be treated as a cash advance (i.e. not a purchase), so would not be eligible for the chargeback scheme. But you've nothing to lose by trying.

    It's true that the vast majority of gambling charge backs are rejected (either by the bank or they just lose the process). But this sounds like a scam website, and looking at it, it looks untrustworthy. I would gather as much evidence as you can (what antrobus just posted will be extremely helpful!) along with concrete evidence that you 'won' the money etc, and ask your bank.

    Bear in mind, though, that ultimately its your banks call if they process a charge back. And some might say no, just because its a gambling site. Unfortunately for you, anyone processing charge backs in a bank is approached all day, every day with requests to charge back or treat as fraud gambling transactions. You have no rightto a chargeback, its at your banks discretion.

    Just a note - I do trust you but also bear in mind, if you have been at all untruthful here and the company submits substantial evidence you actually lost the money gambling, this could get your accounts closed and CIFAs added.

    Usually I would check this stuff out more, it was listed in an email showcasing new casinos from a reputable gambling website.

    Something that may be material to your case is the element of your 'stake' that won. For example, if you placed 215 £1 bets and 214 lost but one of them won £260, you would only be disputing £1 with your card company. Yes, that is an extreme example but it probably will be a factor in your card company's decision to help or not.

    I'm still doubtful you'll get anything because 'charging up' a wallet and gambling with it is what you wanted to do and that's what you actually got. You received your service. Payment of winnings may not be seen as part of contracted service because there is no obligation to pay them back to your bank card.

    Refunds do have to go back to your bank card but we aren't talking about refunds here.

    Any website of this type with a connection to Curacao is usually bad news.

    It could be argued by the card company that you got what you paid for ie your card was debited by £215 and your gambling account credited with the same. You were able to access this credit and gamble with it - hence you received the service and therefore no chargeback.

    The fact that you can't subsequently and at a later date withdraw from your account is not relevant (they might argue) and is a completely separate problem unrelated to the card.
