Clutch gone on van purchased just over a month ago!

My husband bought a van for work just over a month ago and the clutch has just gone! 😮 It was purchased partly in cash and credit card from a dealer. Can we claim against the dealer? Not what you need just before Christmas 😢

    this may be a business to business purchase rather than a retail sale. So consumer rights may not apply. However if the dealer is decent they will replace this.

    The dealer could therefore argue that the fault was not present at the time of sale.

    Has he approached the dealer yet?

    Surely that's evidence that the fault wasn't evident at the time of sale. A clutch is a wear and tear item too so probably won't be covered under any warranty.

  • Thanks to those who have given helpful responses. It cost £8000 & is VW Caddy c20 maxi (2011) on 58,00 miles. Dealer has been approached,and pending exact details of work needing doing from local garage, will give a contribution as a good gesture.

    So since there were no signs of imminent clutch failure when you purchased the van, the question is whether it's reasonable for the clutch to fail on a 7yo, 58,000 mile van.

    A goodwill gesture to get it replaced at a garage of your choice is a good result, depending on the size of the contribution, and reflects well on the supplier.
