    An update on this case.

    Using the information on this site we submitted a Witness Statement that relied on two arguments.

    1st was the primacy of the lease and the second was about the signage.

    The case was heard this morning and UKCPM sent a solicitor along. Gladstones had not sent him a copy of the bundle, so the Judge summarised the arguments for him.

    The UKCPM case was dismissed on the basis that UK CPM could not impose conditions on owners of car park spaces unless the lease was varied by the landowner to require them to comply with those conditions.

    The fact that UKCPM had a contract with the management company was irrelevant, as was the fact a permit was displayed albeit faded.

    The solicitor tried to argue that because she had displayed a permit, she has agreed to the contract. The Judge dealt with that swiftly!


    We were disappointed that the issue about the signage was not part of the judgement because it wasn't needed - we won on the primacy of lease issue.

    To those of you going through similar, it's worth it.

    As newbies to court, it wasn't as daunting as we had imagined and it was over in less that 30 mins and that was because the judge went through the arguments for the benefit of the UKCPM solicitor.

    The counterclaim was dismissed because the threshold for harassment is high and getting their letters doesn't count! Fair enough.

    Gladstones are a joke and it's a wonder anyone will turn up to court on their behalf. I actually felt quite sorry for him.

    He introduced himself and asked who we all were. I acted as a McKenzie Friend for my very nervous daughter-in-law and my son was a witness as the leaseholder.

    The bundle had included his WS and bundle, none of which this chap had been given by Gladstones. We had sent the Witness Statements and bundles in good time by registered post and included a Certificate of Service and proof of postage - all of which were noted by the Judge. He said it was a thorough approach!

    Is it too late to apply for costs? They are minimal to be honest. The defendant is on a relatively low wage and my son was able to take time off work without losing money. I suppose there were costs preparing the bundle and postage. It will add up to about £50 at most but it would be nice for UKCPM to get our bill. If it’s too late then I hope someone going through similar will learn from our mistake. To be honest we were so stunned by the speed of the process that costs didn’t come to mind.
    What is galling is that they have paid out on 6 previous PCNs. 😩

    You can write to the court asking for £50 costs applying to the case. Or send your bill to UKCPM

    I know you love your garden but maybe you could devote a little time here helping others because you have seen at first hand the failings of these scammers

    Thanks for the advice Castle. I certainly will be helping out here. There is only so much I can do in the garden after all and the more I read about Gladstones and the likes of UKCPM the more I feel up in arms. We learned a great deal going though this process and yes, we made some mistakes along the way. If I can help others avoid those mistakes I will. Our next move is to write to the managing agent (MA) outlining the case and informing them of the outcome to try to get them to reconsider their contract with UKCPM. We also want the MA and landowner to write to all residents informing them that they don’t have to pay PCNs issued to residents legitimately parked in their spaces and that they won’t given permission to UKCPM to take residents to court when they have simply parked in their space. Also writing to Sir Greg Knight and our MPs. Any other suggestions?

    The already known Gladstones/IPC/IAS scam

    HOW THE IPC SCAM WORKS:
    1: The motorist gets a parking ticket
    2: They appeal to the parking company which is rejected
    3: They are then given the opportunity to appeal to the IAS
    which is also rejected
    4: Shortly thereafter, the motorist receives a letter from
    a debt collector, normally DRP, who add £60 automatically
    and threatening to take people to court ?
    As you probably know, debt collectors involved in the
    parking scam have no power and cannot take people
    to court. At this stage, due to scare tactics, many people
    will pay, mainly because the fear of a CCJ.
    Whilst it is advised that debt collectors like DRP must be
    ignored as they are powerless .... after a while it is passed
    back to the PPC ....... the £60 is passed back as well, despite
    DRP claiming they "act on a no win no fee" basis

    If the motorist has ignored DRP, then there is no charge
    to the PPC but still the £60 is added and passed on

    The final part of the scam is that Gladstones solicitors
    are instructed and then take the motorist to court and
    adding on the DRP scam £60

    The Gladstones scam goes in a full circle ??? A SCAM

    Sir Greg Knight already knows this as do government

    Thanks Beamerguy - already found this which is why I am getting more incensed. I suppose the reason for writing to Sir Greg is try to impact on the new Code of Practice that is being developed. It should include something about not pursuing charges against residents when they have parked legitimately in their own space.
