In my evidence Bundle do I need to include copies of all evidence references mentioned in my defence or just the evidence to support the points raised in the witness statements? If so, whereabouts does the defence references get placed in the bundle? I.e. separate from the exhibits?

You need to provide evidence of anything that you have mentioned in your defence but more normally in the Witness Statement (WS) and it should be indexed, so for example, in your WS you say Exhibit reference VA/01 pages 1-4, then you should have 4 pages tabbed with VA/01 and they should, along with all your other evidence, be in a separate folder or ring binder tabbed for easy reference for you and the judge to quickly find in court. This folder or ring binder is normally deliver by hand to the court I line with the dates given in your allocation to court letter. For the claimant, e-mail is sufficient.0

So for the evidence not mentioned in the WS I'll place this into a separate tab in the hearing bundle, any advice on what I should call this separate evidence? i.e. how should I refer to this in the index page?
Thanks for your feedback in post #87 do you have any thoughts on the rest of the statement and the other witness statement provided? - that would be much appreciated if you or others have time.

Wherever you refer to evidence (and it is usually in the Witness Statement - WS) use a reference like you've already stated and put together the WS and evidence in a ring binder with the pages all numbered and a contents page. Use tabs on the evidence pages so that you and the judge can refer to them quickly and efficiently whenever you want to draw the judges attention to a piece of evidence - "If I might Sir/Madam draw your attention to Exhibit VA/05, which you will find on page NN in your bundle marked with a RED tab" or something like that.

The issue I have is that the law cases referred to in my defence aren't referred to in my WS (I believe this is correct process) so shall I just add a tab called "authorities" and group all the law cases together in one section? and make it clear in the index in what order the cases are arranged? Also, should I number each page with a pen?0 -
Whichever way allows you and the judge to quickly access the evidence is good. Better put a tab on each page that sticks out so it can be quickly found and to avoid becoming flustered.0

When including evidence like "Information Commissioners Office's ANPR surveillance camera Code of Practice" do you include the whole document or just the relevant paragraphs as an extract in the hearing bundle?
I am concerned that large docs like this (44+ pages) will make the bundle large. I can see this being a problem when trying to scan the WS and evidence for email etc (i.e. huge file size). Any advice please?0 -
In almost all cases enclose just relevant paragraphs/pages. This is the small claims court, not The Old Bailey!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
