Delivered To Wrong House - What Are My Rights?

One small point: if the occupants of the house where your goods were delivered have indeed taken them in, they are not entitled to keep them as 'unsolicited goods'. The item belongs to you, is presumably labelled with your name and address, and they have a duty of care. If someone had purposefully sent goods to them for some reason then they would be unsolicited and things might be different

It's been all of two days though - they have a duty of care, but not a duty to drop everything and get OP their parcel as soon as possible. It isn't that unusual for it to take longer than a couple of days for neighbours to catch each other in and hand over the parcel.

Still no sign of any life at the delivery location. Curtains have not moved. Let's hope it's not one of those "we died 3 weeks ago and nobody noticed" scenarios. Those are rather gruesome by all accounts.

All in all, Mr Courier could have chosen a BETTER location to dump his parcel!

I don't NEED to ask the seller which address they sent it to and there is no possibility that the wrong address was ever used because I know which address Hermes were using..

You do NEED to query this to start the full process of ruling out all eventualities. The sellers response to that specific question and confirmation will also help with any [possible] future legal route. But if you feel you don't NEED it, then it's fine, surely. ;)

The issue was that the photo showed that they clearly HADN'T delivered to that address as it wasn't my garden..

No, the photo showed delivery. Nothing on that photo proved it was or wasn't YOUR garden.

Whether or not the parcel was left outside is sort of irrelevant because if the courier delivered it to the wrong address and there is every indication that this can be proved from GPS/photo evidence then Hermes don't have a leg to stand on because they didn't fulfil the terms of their contract with the seller. Not my problem, but it should hopefully work in my favour..

No, it's very relevant. It matters NOT whether it was delivered to the correct or incorrect address, if the item was left outside is VERY relevant. Certainly for UK legislation.

You seem to have it under control so I will await the "I've now got my parcel and £100 comp" update.

I may have missed it (on a phone) but how much was it and how did you pay/fund Paypal if you paid that way?

Well I don't have a hedge in my garden for starters. Or ANY sort of greenery. But I grant you it COULD have been a potted plant! :rotfl:

Yeah it was Paypal but pretty certain it was cash as it was under £50. So no credit card involved which is unfortunate as I know where you're going with this one. Getting the credit card company involved is always a good idea if you paid that way as they can be pretty good in disputes like this.
  • Quick update. I'm at the hairdresser, getting dye slapped on my head and the phone rings. Withheld number. So I answer (and in so doing get hair dye on my phone) and it's someone calling from xxx Road, the house that the parcel was delivered to.

It's almost impossible to hear her, because a customer in the next chair is getting their hair dried and the racket is horrendous, but apparently the house belongs to her Mum, who I think she says is in a home or something. And she doesn't live there, she's just there picking up the mail.

Can I come and pick up my parcel she says. "When?" I ask. And the response I get is: "I'm only going to be here for the next ten minutes". Well clearly I'm not going to get out of the chair in the next ten minutes, so I say I'll try and raise my husband, but he doesn't answer the phone and by the time I get round there an hour later, the house is dark and deserted and I have no idea how to contact her.

The thing that is bugging me is if neither she nor her Mum live at the house, who on earth took the parcel in on the Sunday? The resident ghost?

    Curiouser and curiouser.....

    A neighbour?

Chances are the daughters only stopping by mums to ensure theres no build up of mail behind the door etc and thus had only allocated a small window of time and couldn't afford to hang around. Perhaps ask her to let you know a few hours in advance when shes next there if possible and you'll make sure someone is there to collect.

Or get back onto the seller and get them to sort it.

Op can’t ask her to let her know in advance as she can’t contact her.

Missed the withheld number part. Maybe wouldve been an idea to ask her while on the phone, but too late now.

Tbh with only a 10 min window, its what I wouldve done anyway - knowing that even if my OH wasn't doing something he can't immediately leave, by the time I called him, he put his shoes & coat on and went round, that 10 mins most likely would've been and gone.
