If tomorrow's diagnosis confirms Mini's Health Check and the repair cost is above say £200 then yes, I'll register a small court claim and pursue damages.
I don't wish to do so but being misled in this way just isn't cricket.
If he was a motor trader I would agree - but it was a private sale and you are suppose to undertake due diligence when buying.

If private selling I wouldn't use absolute terms such as "no oil leaks", if be descriptive without committing "engine in very good condition etc.0

In addition I should mention that the seller informed me that he purchased the car 1 month ago for his wife and that the reason for sale was because she didn't like the low riding position.
He also told me that his friend (apparently a Mini mechanic) did a cash-in-hand service on the vehicle 2 weeks ago.
Now the Health Check not only indicated oil leaks but also that the engine was missing 2 litres of oil.
My suspicion is that he purchased the car, realised it was a dud and tried to pass it on.I also discovered that he placed a circular piece of black tape over the airbag fault warning light, again revealed by the Health Check. Not sure if this constitutes a fit-for-purpose violation or not.
OP - was the current address of the registered keeper on the V5 the same address as the person you bought it from - ie. where you physically inspected (or not) the car - or had he not had the V5 back yet from the DVLA because he had "only bought it a month ago, and his wife didn't like the driving position"?0 -

Make sure you check the bag to make sure it's not leaking - obviously that'll be tough if it's on the bottom shelf and you have to move it0 -
Strange, I though BMW Minis of that era had direct Electric power assistance, the mini we had did. Not sure what power steering pipe there is to leak?0

You could ask that they make a small contribution. You could always take a trip to their house and look for any oil spots on the drive. If you can show them, it might strengthen your argument.
Other than that.... you're onto a loser.0
