NCP ANPR Crawley

Hello

I have read the newbies thread and I'm not sure if the standard response is right for my situation.

Background:
- Parking date 25/10/18
- Received NTK from NCP for alleged "parked longer than the time paid for"
- NTK says it posted on the 5/11/18 but I'm sure it arrived on the 8/11/18 which is 15 days...Not sure if this can be used ?
- The car park was recently pay on exit and it changed to ANPR
- The driver arrived say at 8:00 and left 17:15 and brought a ticket 10mins before leaving for £2.50 which covers 24hrs. As the driver thought this covers the parking period, as they used to do
- there is only one tariff upto 24hrs for £2.50
- The keeper hasn't responded
- NCP NTK has pictures of the car entering and leaving and looks like it meets the requirements NTK.
- The signs by the ticket machine do not mention anything about buying tickets on entry.

I have many pictures of the signs around the car park and I'm happy to upload them if needed.

Questions:
- Is the standard text appropriate for this example ?
- If not how should I respond ? or should I ignore it ?

Sorry for the questions and I really appreciate your guidance as I'm not sure what to do next.

It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
You never know how far you can go until you go too far.

Send the one size fits all blue text appeal found in the first post on the NEWBIES FAQ sticky thread.

Send it unaltered - no additions or changes necessary.

    Send it as the keeper.

Is the standard text appropriate for this example ?

The standard text says ''one size fits all'' for a reason. it is purely to get a POPLA code.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD
  • Thank you, the keeper wasn't sure as one of the paragraphs talks about providing photos and they had provided these in the NTK.

Will now send this text unaltered.

The template talks about providing all the photos.

Have you any way of knowing if there are more photos than you have already seen? ;)
  • lol - good point well made :)
  • sorry one last question....on the NCP appeal page I have entered the details as the keep and copied the text in to the appeal in the reason "other". They have asked for an email address (although not mandatory) and they said I will find out the appeal via email. Should I add an email address ?

    Yes.

Perhaps create a throwaway gmail account.
  • good idea and thanks for the quick reply.
  • Hi

Are you able to post the 3 missing links from your first post now or just type them in.

Would be very useful as I've just been done at Cross Keys NCP car park off The Broadway in Crawley.

Very similar. Entered almost full car park. Found 1 tiny space in the SW corner. Lots of mindless reversing and trying different things. Got in but I couldn't get out of the car. Left car park. ANPR PCNtK got me for 13 mins 1sec!

Will be starting a new thread soon but it would be good to see your letters to make a better defence/appeal.
