    I think that's too long. No need to tell the landowner about the BPA CoP, or this:
    To summarise as the registered keeper I wish to refute the parking contravention on the following grounds:

    1) The operator has not shown that the individual who it is pursuing is in fact the driver who may have been potentially liable for the charge
    2) The operator’s failure to adhere to the British Parking Associations (BPA) Code of Practice relating to Grace and Observation Periods,
    3) ParkingEye Ltd. lacks proprietary interest in the land and does not have the capacity to offer contracts or to bring a claim for trespass, and the witness statement since received is dated after the date of the incident in question.
    4) Signage does not comply with the BPA Code of Practice and the small print specifically was not prominent enough to form any contract with a driver

    It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    I am sorry to hear about the position you find yourself in, but regret that we are unable to help.

    Whilst our company owns the land, we have no other connection with Parking Eye and their management of the car park. We own the premises that Laura Ashley conduct their business from but have no say in their terms and conditions.

    I visit the thyroid clinic at Sunderland hospital and on one occasion received a ticket for overstaying. I over-looked the fact that I could have covered the overstay by making a further payment and so had to pay the fine.

  • How would Laura Ashley influence however given they are not the landowner, Peter F Robinson have signed the witness statement with Parking Eye?

    That suggested to me that Laura Ashley were renting the land; you may want to check with the council who is paying the business rates for the site.
