Management Company wishes to introduce a Parking Scheme

I own a leasehold flat that is a recent new build. The management company emailed everyone to say they are starting a Parking Scheme and have got parking control company, PCM to administer it.


I am trying to find out my options to attempt to stop this happening as I have discovered first hand in the past that this doesn’t work out well. My searches have only dug up posts discussing how to get out of tickets and not how to stop this scheme from happening.


I have checked my lease and the only sections regarding parking state I must parking within my allocated bay (which I do). I must also not restrict access to any other parking bays.


I have checked to see if there are any grounds in which the lease my be varied by the management company and I have the below text


“Acting reasonably at all times the Management Company shall have authority to make and at any time vary such Estate Regulations as it may reasonably think fit for the preservation of the amenities of the Estate of for the general convenience of the occupiers of the Dwellings PROVIDED such estate regulations are notified to the Tenant and other owners and the Landlord in writing”


Is the above all they need to introduce a parking scheme? Is there anything I can do to stop this or at least allow for my parking space to be omitted from this scheme?

    Yes.

    No.


    And, even if you did, don't moan if your parking space gets taken by others.
  • Have a read through the below thread and refer back to your lease helpful advice and links - my mother recently has same produced title plan and lease extract - management company backed off the enforcement of allocated bays and only check visitors bays which is fair enough as the visitor bays get abused by residents with multiple cars

    I would suggest you speak with other leaseholders and see if you can get their support.
    You may find other leaseholders have requested a parking scheme?

    Who owns the freehold? Is it a separate freeholder or have the residents got it. If it's the residents there will be directors who you can raise the matter with.

    You can suggest an alternative.

    I'd also be asking the management company what authority they have and who will the contract with the PPC be with.

    I am a director of an estate and am fully aware of the issues that rogue and selfish parkers bring. However, I'd be strongly against parking enforcement on residents own allocated bays. Common parts and visitors spaces are different.

    As asked above, is there currently a parking problem?

    If there is, and the parking company solves it, who do you think they will target (for minor, petty "infringements") in order to keep their revenue stream going?

    A parking scheme was introduced at the flats I used to live in because peoople from the surrounding houses were parking there, and there were also two cars dumped there.
    Didn't bother anyone who was actually parking correctly.
    Why is it bothering you? How many cars have you got?

    If you are a well behaved citizen/motorist, I can only see this as a positive step.
    It's only going to stop the badly behaved or ignorant people.


    There a slight concern about minor infringements but if you know about it in advance then it's pretty easy to check your car is within any lines (which if you are considerate you'd be doing anyway).
  • Ask this on the parking ticket thread on motoring forum. I'm sure I've seen them get these removed or advised how to beat them. If I remember correctly the pick can only issue pcn if the contract is with the freeholder not the management company. So if the pmc attempts to sue you for trespass as you didn't pay the invoice it gets thrown out as the management company didn't have the authority to sign the contract.
  • There isn't an issue with parking. In fact, you need a key fob to get into the car park and each space has a pole you can raise to stop people parking in your space when it is vacant.



    The residents do not currently have the freehold. It is still with the developer. It is a new build and not all the flats have been purchased yet.


    I will check with the other leaseholders. Sadly alot of the block is rented so that could be complex.
