CP PLUS Payment Demand

I have spent a few hours reading through all the helpful posts on this forum and just wanted to ask for a bit of definitive help as it seems that there was quite a big shift before and after PE vs Beavis. Not quite sure where I stand on the issue detailed below:

My car was registered as overstaying the max number of hours at a retail park by CP Plus on the 7/11/18. Date of notice 19/11/18 and letter received on the 22/11/18. Penalty charge £50, South East London.

It appears that just ignoring the penalty is no longer an option as of PE vs Beavis '15. This would naturally be my prefered option. :D

Should I send an appeal or is more likely since PE vs Beavis '15 that I will have to pay? To be honest I really loathe these kind of companies and would much rather not give them even my time &/or money.

Please forgive me if this is already covered in previous threads but I am a little confused on an up to date precedent. :beer:

    Send the already written for you blue text template appeal you will find in post #1 of the NEWBIES FAQ sticky thread.

    Send it unchanged - no additions or alterations necessary.

    Send it as the keeper.

    At the same time complain to the retailers and/or the retail park management.

    Easy one - CP Plus will probably cancel first try when they see the forum template in the NEWBIES FAQS sticky thread. And if not then by NOT saying who the driver was, you will likely win at POPLA because CP Plus do not use the 'keeper liability' provisions in the POFA.

    So read the NEWBIES thread, submit the template appeal and you could add that you know the NTK is a 'non-POFA' one and is incapable of holding you liable so they should just cancel.

    When sussed, CP Plus normally cancel within a few weeks, no need for POPLA!
