  • A wonderful letter arrived from gladstone's asking me to pay DRP - I assume the same principle? giving me 14 days? sating that the client has the option to proceed to a civil case - although apparently they prefer to resolve as soon as possible - according to the letter.

    Happy new year! I thought I’d update on the current status... just before a Christmas a letter arrived from Gladstone stating Letter Before Claim.

    The letter gives the keeper the option to raise a case within their system, which they are hesitant to do. However they give the keeper 30 days to respond.

    What are the thoughts?

    On further review The original PCN states the breach was on double yellow lines, however the images taken by the keeper and the operator shows the vehicle on single yellows... if that helps?

    What do you mean 'raise a case' that you are reluctant to do? You mean reply to Gladstones using their online contact? Yes, do so.

  • Yes I have sent the SAR and the data restriction request to them. Does that constitute as a reply, as all the give in the LBC is to use their reply forms that the newbie thread states not to do so

    Did you include proof of ID such as a copy of the V5 with the SAR? This goes to the PPC.
    The put on hold instruction goes to the scamlicitors. You should tell the latter, "although you deny any debt, you are seeking debt advice and therefore, pursuant to the pre-action protocol for debt claims 4.2 you require them to suspend the action for 30 days".

  • The keeper included the name and address, including the vehicle registration within the SAR to the PcN via email, in addition to a previous address that the original PCN was sent to. I did note that they seem to not have updated the details from the V5 as the keepers name is spelt wrong... On both correspondence.

    The hold request was also sent to the “solicitors”

    Does that need a similar adjustment?

    Distinction between the driver and the keeper really is important, and carelessness can easily cost you the case.

    It is known that the parking companies trawl this forum just waiting for people to trip themselves up and can try and use your posts against you.
