    Dropped the ball again Mr C!

    As a landlord for over 40 years I am well aware how gently I must treat my tenants and, If I treated them as many PPCs and MAs do I am sure that I would soon be in front of the Beak

    I do not care how high the law sets the bar for costs for unreasonable behaviour, harassing residents suchly is , unquestionably, unreasonable behaviour, and probably a breach of their right to quiet enjoyment of their property under The Landlord and Tenants Acts.

    I only wish people had more cojones, were I in that position, I would hire a lawyer and go after them with all the force I could muster, hang the cost.

    Also, this all too frequent adding of allowable costs which seems to e sanctioned by the down market law firms which service the scammers, sure this is a breach of their Code.

    Yep I sadly agree and I absolutely know they don't give a toss, its a real big gravy train for them BUT as WE all know nothing lasts forever and their train will run out of gravy one day (soon I hope)

    Only 4 active legals, two being highly aggressive ? We are not trying to get rid of the legal profession, only those who are rogue traders

    I am certain it will happen sooner than later. The courts must play a big part in this

    Each time a judge refuses unreasonable behaviour costs the PPC wins.
    You never know how far you can go until you go too far.

    Not really.

    In yesterday's Guildford case, the PPC will have paid £25 to file the claim, £25 hearing fee, plus Gladstones fees for preparing the claim and the WS. Then they have to pay c. £150 for the advocate, plus the Defendant's costs of £105.

    The Defendant also has other PCNs from the same location, as do other residents. She will now be getting a transcript of the Judgment, and using that in the defence of any future claims, and giving copies to others.

    If any further claims are brought, there will then be a much stronger argument for awarding unreasonable behaviour costs, given that the matter has already been determined res judicata.

    Any consideration for a counter claim in further claims?

    Is it not time for the MA to ditch this parasite, these people can adversely affect property prices.

    I've already told my children never to consider purchasing any property where PPC is in situ. Undoubtedly as these residential cases become more wide-known, they can only have a negative impact on values - sales or rentals.

    The more the message gets out that not only will PPCs cause residents day to day stress - a nuisance in itself - but more fundamentally, they will affect the value of their property, the better.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • I have an on-going case with the same PPC, can you give more details about what was said in relation to the signage? It seems UK CPM rely on an almost identical template sign at all residential sites they prowl. Thanks in advance

    Pretty much, UKCPM, same old rubbish signs, same old rubbish rejections, same old rubbish Gladstones Solicitors, same old whooping in court
