Don't worry about that for now. At the top of this board is a thread that tells Newbies to read it first. In that thread is a section on court and set asides.

Not receiving court paperwork is good grounds for a set aside. I'm not going to pretend it's easy. It isn't. It requires work from you.

You can pay this and it's over. Or you can fight and get a set aside. What you do is up to you. In saying that you are here. We don't give in easy.
  • Thank you so much for replying.
I will read the notes you mention.

If I pay will the CCJ 100% not be on my record ?
I really don’t want to as I feel like it’s completely unfair.

If you pay the ccj within the time frame allowed it is expunged from the records.

In saying that you need proof it has been payed. There is no incentive for the payee to provide proof so if you don't have any you can pay and still have a ccj.

Fight or fold is your call and nobody here will criticise you either way. There is no "correct" answer. Just make sure whatever you choose every I is crossed and T dotted.
  • can you pay and then still fight it after ?
    Thanks
Think I’ll skeep on it !

If you pay and can prove it to the satisfaction of the court then that's it. Over. No comeback or fighting. You've admitted being wrong and cannot alter that.

If you obtain a set aside (and that isn't guaranteed) then it sets the position back to the start of a claim. You can fold more easily or fight with more information. Some posters have negotiated the payment down to about £60 others have failed.

I don't want to paint a rosy picture either way. It's a really difficult call and no one can make it for you. We will assist either way though.

Have you actually got a CCJ?

    Or a claim form?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • No it’s a CCJ with a month to pay by this week. What is satisfactory proof ? Do you get a receipt when you pay ? And /or bank statement ?
  • Get a receipt from tehm, and send it to the court. Theyre supposed to tell the court, but if they dont, there is no come back against them.

You can pay and THEN apply for a set aside, whcih is a pragmatic approach.
  • Ok thanks I will do. I’ve only just collected my post yesterday and have two more tickets at debt collector stage 2nd letters so need to deal with those !!
Thanks to you all for advice a lot less anxious !
