S75 Consumer Credit Act

I hope somebody may be able to give some advice.

On 27 December 2017, I purchased from a major High Street retailer an Apple iPad Pro spending £719.00 on it. It came with a 2 year guarantee which I was told also cover accidental damage.

My iPad Pro has been working very well and I have had no issues with it.

In early October 2018, the screen became cracked. I contacted the retailer and they confirmed that it would be replaced/repaired under their guarantee so I returned it to the store. In store I was advised that it did not have accidental damage cover and there was nothing they could do!

I emailed the Head Office making a complaint and also emailed my credit card company. The retailer did make an initial offer of £80.00 which was increased to £212.00 and increased today to £250.00. Apple themselves want £426.44 for a replacement screen which is over half the cost of the iPad and on speaking to them, they would consider it beyond economical repair.

Communication with my credit card company has been difficult as the department which deals with S75 claims does not have an email address! I have contacted my credit card company today by phone to advise of the increased offer which I have stated I am not prepared to accept. My credit card company have also advised that they have received no reply to any of their letters from the retailer.

I have advised the retailer that reluctantly I will contribute 50% towards the cost of a replacement iPad (like for like) which they have declined.

Where do I stand with this?

    is their offer based on a liability of mis-selling by verbally giving incorrect info?
    what does the paperwork say?

    What paper work did you get for the 2 year guarantee?

    Who provided the cover?

    As per above, it's what can be proven in writing that matters .. he said/she said cannot be proven so if they only told you accidental damage was covered, but it's not on the paperwork, then you may be scuppered.

    The warranty comes from Apple and it does not cover accidental damage. Did you buy any other cover?
  • AppleCare+ does cover accidental damage. The older regular AppleCare did not.

    if they had AppleCare+ then this wouldn't be a problem, the reason it's on here is obviously because they don't have AppleCare+.


    But we still don't know if any extra warranty has been purchased.

    I never said They had, I had a issue with your statement:
    The warranty comes from Apple and it does not cover accidental damage.

    which reads as if Apple never cover accidental damage, which is patently not true. AppleCare+ has been around for a few years and an iPad Pro purchased a year ago would have qualified.

    Your link shows you can buy added accidental cover.

    I did purchase my Apple iPad Pro from John Lewis. I was not told about Added Care at the time of purchase only when I returned it for a repair/replacement last month. During a telephone call with John Lewis in October I was also advised that accidental damage is included in their 2 year warranty. Although all telephone calls are recorded, they have advised that they had technical issues with their system on that day and are unable to locate my call! I have told them that had I been told about Added Care then this would have been purchased at the time. It is only £70.00 which on a £719.00 iPad is 10% of the cost.

    John Lewis has stated in many emails that I have received poor service and also been misinformed which doesn't help me in the situation I am currently in.
