payday type loans - advice please

  • SAR UPDATE

    as expected , the SAR does NOT show the fraudulently taken out loan , however this was reported to a credit reference company and DID exist

    I would have thought that a SAR covered ALL dealings with company , not just selected ones

    am I correct or not ?

    A SAR must cover all data held relating to the subject. We have to produce them now for a client - it even has to include the request for the SAR itself.

  • although I am asking this question elsewhere , you may know the answer to this question

    of as in the case above a fraudulent loan was made AND REPORTED ON CREDIT FILE , but then challenged , and cancelled , would this loan and reporting of it + phone call making complaint not be included in SAR ?

    all info should cover fake loan + cancellation ?

    it depends on their internal systems. If, as part of the cancellation, they deleted the data at that time when they recognised the error then there might be nothing to report. If there is a record of the whole sorry tale in a complaints system then that should show on a SAR.

  • yup , but neither the fake loan , the cancelation or the phone calls are in the sar , however they DID report this to a credit agency , how can they deny , what they did

    SAR covers personal data held, not all interactions/actions unless the fact of those interactions is recorded in a system somewhere as data
