Day At Court

Hello , I need a bit of advice please.
So I have been issued a Parking Charge by parking&property management ltd. I appealed to them but was rejected, then I referred my appeal to The Independent Appeal Service which in turn rejected my appeal. And today I receive a demand letter from bwlegal for the original full charge @ £100.00 + £60.00 initial legal costs of their client ??
I feel I had not received justice in this matter, is the whole case arguable in court, ie do I get to put forward my view ??
If the answer is yes, then I will post the relevant information about this so we can agree best action.

    You will more than likely have your day in court as P&PM are quite litigious - but you're not there yet.

    By when have BWL demanded a response? Did they enclose anything else with their letter?

    You are just another one that BWLegal are trying to scam.

    NO INITIAL LEGAL COSTS.

    This is a fake add-on debt collectors charge. Were you chased by DRP ???

    Was this letter a LBA giving you proof of their claim and giving you 30 days to respond ???

    As bargepole on here has said ..... "artificially invented figures in an attempt to circumvent the Small Claims costs rules using double recovery"

    the demand letter from bwlegal is dated 13th Nov, they ask for full payment within 16 days from letter date, should i not pay or not provide reason for non-payment then they will seek their client instructions.


    that would be the 29th Nov

    It's all part of the trash from BWLegal.

    As you do not owe £160 why would you think of paying.
    The starting charge is £100

    BY LAW they must send you a LBA (Letter before claim).
    This letter contains forms which you ignore but they must provide you with proof of their claim and give you 30 days to respond

    So, you have a debt collector letter

    If you get an LBA then come back here for help

    That's not a letter Before Claim (LBC) - just file it, no response advised.

    Please read the NEWBIES FAQ sticky, post #2 which will be your guide once/if the court process commences (when formal LBC is received). It will prepare you for what might be ahead, and the better prepared you are for this, the more successful you are likely to be.

    While we will help with advice and guidance, the forum will not do the work for you. Preparation, preparation, preparation.

    Parking & Property management ltd have produced a map ( site info plan ) with enforcement date 19.05.2017

    My car was parked in a space / spot that was not covered by them yet they add ( Area has extended ever so slightly 30.05.2015 ) , bearing in mind date of my parking charge 2nd June.

    They state that Signage is prominent throughout the parking area. Signage location, size, content
    and font has been audited by the Independent Parking Committee, yet they have not erected any new signs to mark the new added area , just being a bully about it

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. It has even been suggested that some of these companies have links with organised crime.

    Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by in the not too distant future..
    You never know how far you can go until you go too far.

    Just do as Umkomaas said. No-one here pays, but the process and examples of people's 'day in court' are already covered on this forum in full. We do not need to chew over every case, and we just can't, not in advance. What you need is already here:
