    POFA is a law that came in 6.5 years ago and the NEWBIES thread has extensive advice about it and how it protects KEEPER`s of vehicles with hoops that the PPC must jump through to hold a keeper liable (you could google it as well , its not new)

    DRIVERS are not protected by it at all, hence why we keep telling people not to blab about who was driving

    so as an admitted driver, POFA is of no use to you, but after this is all over, study it for your next PCN, because it may help you in the future (but not now)

    its DEFENCE , no S (as in your defence draft over on page 2 previously)

    no , no evidence at the defence stage (which is where you are at), so no photos , no documents , nothing EXCEPT the defence , which usually fits on one side of an A4

    all the info and advice you need is in the NEWBIES thread, posts by BARGEPOLE and LOC123 tell you what goes in and when, so photos etc go in at the WS + EXHIBITS stage

    plus examples of a DEFENCE are also in that post #2, like the concise defence by BARGEPOLE

    Hello Friends,
    this has been going and coming back for a long time, now I have received from the court a proposed allocation to the small claim track and I am suppose to fill in a mediation form.
    also I have received fro the other party copy of their reply to the same, they are happy for this to be dealt with the small claims court.


    I really thought that this should be dealt with by Traffic Special Court as I am disputing their right to issue this charge and judgment should be based , mediation will not help while each party is claimimg to be correct, should I just refuse this offer ??

    No to mediation.
    No for it being heard on papers.
    You must state to the court you want this heard at your local court.
    I have no idea what a traffic special court is. If the alleged event occurred on private land the hearing will be in the Small Claims Court.

    Surely you were expecting that?

    Items 7 and 8 on the list in post #27 above were intended to alert you to what would happen next and also suggested how to deal with it.

    This is a private parking company issuing an invoice they say you refused to pay it has nothing to do with traffic violations or real parking penalties.


    You seem to be going off on a tangent and wasting your time there.
