Debt recovery letter for T mobile but never had a contract.

I received a debt recovery letter from Moorcroft debt recovery ltd with an outstanding amount of £12.88 due to EE (T Mobile) however I have never had a contract or phone with this company. I use PAYG and Tesco always have. Now I get an update from clear score saying a default will shortly go on my credit file.

A couple of years ago I received a bill from T mobile for this bogus account and phoned them. I was told it was a mistake and would be sorted.

I've phoned again today but I'm being told they cant really do anything as I don't have an account and I cant answer security questions on an account I know nothing about.

Im really angry and have fired off an email complaint but what can I do to resolve this ridiculous situation.

This actually impacts on my work. Im a mystery shopper and Im going to have to turn down a lucrative assignment with a high street bank as I have to have a clear credit file.

Is there anything in your credit files? Have you checked this?

    Send EE(T Mobile) a SAR.

I have not checked my Equifax credit file yet but Clear score have informed me a default will show on my account shortly.
I had to google SAR but as I understand it this will cost me £10. I do not want to be out of pocket for a bogus debt of £12.88.

If Clearscore informed you that it was Tmobile, and Tmobile deny ever having you as a customer, I would send Tmobile a letter before action giving them, say, two weeks to rectify everything and threatening them with court actions otherwise (for defamation of character).

Also, Clearscore isn't a CRA. They just use data of other CRAs. Find out what CRA their warning is based upon. AFAIK, all CRA allow disputing any information they hold on you.

Using the small claims court in that way may be problematic. It works well for debts, not so clear cut for other issues. It would be better to instigate a formal complaint and then take that to the Ombudsman if not resolves by EE.

I know. I hoped the LBA could do the job, but as the complaint can take up to 8 weeks it's possibly worth starting the complaint as well just in case.

Hi guys checked Equifax and default is showing. Informed Equifax of error and complained to EE who took over T mobile. Asked for my complaint to be sent to fraud dept and threatened taking the complaint to FOS if the matter is not resolved promptly. What a fiasco and waste of my time.

  • Equifax won't delete it permanently unless instructed by EE. The FOS won't do anything because they don't deal with mobile complaints. The relevant Ombudsman won't look at it until you have a deadlock letter from EE or have waited 8 weeks since the original complaint.

The OP could, however, complain to the ICO about TM's mishandling of his personal data.
