    Appears to be a case of buyer's remorse, didn't read the auction/sale page properly and then want's to cancel purchase. Has procrastinated and not followed initial process and muddied the water.

    No not thats what happened. Gosh i would never ask for advice on here again. Some very rude and judgemental people. No thanks.

    I very much doubt that this. Your scenario with regards to fake/replica goods will come up almost daily on ebay so they'll have long ago been aware of what the legal advice is.

    It's well known that people are told to destroy the items and they will get a refund. But in reality the get both.


    Your pig headedness not to return the item despite being told to has this time came back to bite you.


    Sought legal advice, yea maybe 20 years ago.

    It is not clear from the OP's posts just what the seller states in their listing, does the seller actually state that they are replica, counterfeit and fake goods or just that they are replica?

    As above put a link to the sellers listings as you say they are still selling items using the same wording.

    When you buy something on eBay you have an absolute right to return it

    if you return it as 'item not as described ' then the seller pays the postage otherwise you pay the postage

    all you had to do was open a return and return the item, pay the postage and you will have got your money back. On this occasion I think it's fair that you pay the return postage at it was your mistake initially.

    on no account destroy the items why on earth would you do that?

    P.s. just to add you have no claim against aqua you didn't pay with your aqua card you paid with PayPal

    the fact that Paypal subsequently took the money from aqua is a secondary transaction and nothing to do with the original transaction
