CLAIM for Court over UK Parking Management
OfftheHoof
I am being taken to court by UK parking Management Ltd and Gladstone's Solicitors. I have received the CLAIM notice from Northampton Business Centre. I have responded and Acknowledged the Service of the Claim and printed a copy on Money Claim online. I now have 28 days to create a defence. I have no idea where to start.
How do I prepare a defence on this basis?

Magistrates?? I bet that word isn't mentioned anywhere on the Claim Form.

What is the Issue Date on your Claim Form?0 -
Well one really easy way to get the info is to send a Data Subject Access Request to the parking company
You can find out who their DPO is from their webpage
They have to comply within 30 days.0 -
Everyone is politely asked to read up on this in the Newbies faq thread near the top of the forum before starting a new thread
Go there now and read up #2 there which covers court claims through to the hearing
Lots of links to other resources to use to help with what to do and when as well as links to defences to tailor
Throughout you are advised never to reveal whowas driving
You need to edit your OP to remove details of who was driving
The ppcs monitor here and can use your posts against you0 -
issues date is 08.11.180

With a Claim Issue Date of 8th November, you have until Tuesday 27th November to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox link from post #2 of the NEWBIES FAQ sticky thread.
Having done the AoS, you then have until 4pm on Tuesday 11th December 2018 to file your Defence.
That's four weeks. Loads of time to produce a perfect Defence, but don't leave it to the very last minute.
When you are happy with the content, your Defence should be filed via email as described here:
1) Print your Defence.
2) Sign it and date it.
3) Scan the signed document back in and save it as a pdf.
4) Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
5) Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
6) Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
7) Wait for your Directions Questionnaire and then re-read post #2 of the NEWBIES thread to find out exactly what to do with it.0 -
Thanks Quentin. I have read Newbies but its overwhelmingly broad and therefore difficult to take everything in. I felt I was ready to post.
I don't think there is anything on my profile that will identify me. I have changed my privacy settings in case.
I don't know what an OP is?0 -

I have done all the AOS as mentioned in my original post - it is knowing what to include in my defence that I need help with....0 -
You won't take it all in after one sitting!OfftheHoof wrote: »Thanks Quentin. I have read Newbies but its overwhelmingly broad and therefore difficult to take everything in. I felt I was ready to post.

I don't know what an OP is?
Take it in chunks - concentrate on #2 there (includes advice on preparing your defence)
Not your profile - you need to edit your 0riginal Post (OP)
Use the third party as in "the driver" did this/"the keeper" did that0 -
OK, sorry my post was of no help. Please forgive me. I won't trouble you again.OfftheHoof wrote: »I have done all the AOS as mentioned in my original post - it is knowing what to include in my defence that I need help with....0
