Torby Posts: 1,704 Forumite
Just curious to see what anyone else makes of this...brief outline:

Daughter wants mobile phone

3 Shop wants verification of who she is (just moved into her house)

Advises, bring your mother with you into shop

Mother (my wife) visits shop

Shop staff take my wifes details...my wife on no less than three occasions asks why all this is needed...she already has a 3 phone in her name

Shop staff take my daughters bank a/c details for payment on contract

1 month later....my wife gets phone bill in her name!!!

Contacts three to say its been posted to wrong address, should have gone to my daughter, 3 arrange to redirect

2 months later, they contact my wife by phone because bill hasn't been paid, turns out that because the direct debit and contract name didn't match....it fails....

my wife explains that it should match, the phone is our daughters

'fraid not they say....what!!! says my wife....I said in the shop I didnt want a phone, I was only here to verify details

tough you signed for it!!!

fraud or what...keen salesman on comission....or mistake....

answers please

they were probably worried about your daughter failing the credit check and decided to put it under your wifes name instead
did she sign a contract, what paperwork do you have?
pretty serious and very dodgy i'd get straight onto 3 head office about it asap and CC the complaint to the store manager
    Yes Your Dukeiness :D

While the OP wife shouldn't have signed anything Three are a very nasty company to deal with in regards to trying to force contracts on people.

I had a issue with them earlier this year when they tried to bill me for 2 mobile phones when I only asked for and received one. This is a clear breach of contract and I subsequently found other people in similar situations.

I suggest the OP wife and daughter write* joinly to Three stating who owns the handset and who would be paying for the phone giving them 28 days to sort the matter out. Send the letter via recorded delivery and ask Three to contact you in writing to sort the matter out. At the end of the letter inform them if they don't sort the matter out you will instigate court proceedings for breach of contract. After 28 days if they haven't done something send Three a "letter before action" givng them 7 days to sort out the matter and start court procedings for breach of contract.

Three's terms and conditions clearly state that you don't pay for a contract if you haven't received a handset if your contract with them is for a handset and service. This is where they commonly breach their contract with consumers as they charge them for a service when they haven't received a handset. (The contract is in your daughter name with your wife's account details so your wife hasn't received a handset.)

BTW Three's next trick is to phone you up and offer you a handset for a contract you didn't agree to in the first place. If they do phone up tell your wife and daughter not to speak to them until you are around. Then if you are around put the call on loud speaker. The reason for this is Three threatened me in an intimidating way with debt collectors as I refused to accept a handset for a contract I didn't agree to in the first place.

*Any of you can write the letter but it should be signed in both your daughter and wife's name.
    I'm not cynical I'm realistic :p

i have to agree with this, why give out all your personal details and id, then sign a contract and be surprised when a bill turns up addressed to you!!
:p It is better to be thought of as an idiot than to open your mouth and remove all doubt

because my wife specifically asked the salesman why all this information was required? on three different occasions....and was told it was for verification purposes

She was told she was signing the paperwork to verify our daughters identity as she didnt have photo id with her from her new address as she had just moved in. My wife also pointed to the 3 mobile phone sitting on the counter and pointed out again she was already with Three and that was her phone and this was a contract for our daughter...they also took my wifes details as my wife was referring my daughter through their refer a friend scheme as my wife already had a three contract...and my wife got credit on her a/c for the RAF...so figure that one?

so as far as my wife was concerned...she has a three contract...didn't want another three contract...and had specifically said on those occasions the phone was for our daughter...and was told what she was signing was to verify our daughters identity...

as regards the saints post....hopefully you can see my wife asked all the relevant questions and was told what she was signing was for verification and RAF

its one thing signing something when you don't know what it is....but when you specifically tell the salesman AND direct him on 3 occasions that you do not want to take a contract on a new phone and he tells you what you are doing is verifying somones identity...something is not quite right

for everyones information that may read this; I basically posted this to see if anyone has similar experiences....a complaint has already been made to the three executive office and they are investigating, a three store manager in another location has also indicated that this seems to be a bit underhand...and if you check the first line of my OP it says

"Just curious to see what anyone else makes of this..."

The problem you have is that there are two pieces of evidence - the spoken words of your wife and what she says the salesman says, and the document she signed.

As far as the spoken word goes, there will be another version from the salesman's pov.

As far as the signed document goes, it is there for all to see.

That should be conclusive proof about who signed what!

I don't doubt that your wife was duped, but she either she did not read what she was signing, or 3 have forged her signature.

    Pretty simple to prove.

My money is on my original post in this thread.

You may be able to claim "fraudulent misrepresentation" (quick google will explain it in more detail)

Also how old is your daughter?
    SLC: £13000+

    Quidco
    : £
    131.24 (paid) + £0 (validated) = £131.24
    Valued Opinions
    : £75 (paid) + £52.30 (received) + £4.50 (pending) = £131.80
