    Police ended up giving the driver who went into me a driver awareness course within a couple of months as he accepted it rather than prosecution

    To update, I got the details for free from askMID as suggested, the option is 'askMID Roadside' service, to be used on a mobile.

    I phoned the other party's insurance, mentioning I have three witnesses, some CCTV and have reported it to the police, but car is part of a fleet and so I have to wait for a broker and the insured etc to sort it out. When I mentioned police, they went ' oh bless you, please don't have any expectations from them' :rotfl:

    Police took statements from me and partner and counted us both as witnesses (as opposed to insurance where passengers cannot be witnesses) and mentioned that if found, they would intend to charge the person for failure to stop and failure to report. I don't care if this happens, in fact it might be too harsh, but just giving all the details for anyone who might be googling these issues in the future, like I did before posting.

    One month update :

    1. no update from the police
    2. TP insurers kept fobbing me off ( fleet insurance, broker needs time to get in touch bla bla) then I get a text saying no one from the company admits to being in an accident, can I describe the driver. Partner gets annoyed and gets involved, insurers deny even having witness contact details ( which I provided a month ago). They keep insisting that I go through my own insurance. Anyway I have now emailed some CCTV and three witness statements which I have copies of. Got told to wait one week.

    3. Informed my own insurance yesterday - got told that by the sounds of things they are not able to pin liability on the other driver ( !? 3 witnesses, 1 passenger witness, cctv and police report), I would have to claim as a at fault accident with excess payable, which I would have to recover myself from the third party even if proven that not at fault. Cherry on the top was when the person on the phone told me that the other driver will try to say I hit them from the back...! How delightful.

    Dealership has given me a quote for repair for approx £1500. Excess £700 and possibly loosing NCB....if TP doesn't accept to repair, what should I do ? Is it worth going through some of those companies that do claims for you?

    They won't touch it if it isn't a slam dunk easy win. :( They don't like to work hard for their money, or even to risk not getting any.
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))

    Yeah apparently no one likes to work hard for their money!

    Last time I was in an accident (at a mini-roundabout ) there was one witness and my insurance kept saying that if he holds me at fault that's it, they will accept liability. The witness was lying, so to my relief they never gave a full statement and it went as 50/50, but how come I now have three witnesses saying I was stationary and this car reversed into me and my insurance is saying that's not enough and he might claim I hit him!? :mad:
  • Who's fleet? Bit of a longshot but if it's a company with a reputation to protect, you could try shaming them via social media

    Any company with a fleet worth its salt will know who was driving, or at least who signed for the vehicle.

  • I'd be tempted to issue a letter before action to the company stating you intend to recover the repair costs through the courts.

    For claims such as this the small claims track is relatively simple.

    Not a known company, in fact I have no idea what company. Car was a small 16year old hatchack so can't be a very well off company.

    So a letter to TP insurance stating I plan to take court action if they don't step up to repair? Can you give me slightly more detail, never heard of this approach, would be willing to try ofc.

    After endless chasing by my partner, and having sent three witness statements, photographs and CCTV showing us at the scene of the accident(but not the accident), apparently the driver ( or their employer, not sure) finally admitted liability. My car was taken in at an approved repairer for my car’s make before new years and got it back today. My partner says I am being stupid, but I am horrified that the hire car I was in costs £400 something a week, I had it for three weeks due to holidays and repairer not getting approval for repair and parts order from the insurer, although insurer was the one pushing me to take the car in ? The cost of the hire car would need to be covered from somewhere and it’s one of those cases where we all end up paying for it through higher premiums.

    Blame the accident management company appointed by your insurer/TP insurer (as applicable). They seem to have deals with hire car companies whereby the cost seems to be exaggerated because it's an insurance claim. Insurer's use the line of increasing costs of claims to bump up their premiums every year, yet they're complicit in the whole thing!
