Claim Form - Gladstone Solicitors / PACE Recovery & Storage Limited

Hi All,

Didn't really want to start another thread but could not find an adequate answer to my question.

First time on here and so far there seems to be soo much knowledge here so hoping someone can advice best defence and a sense of direction.
car parked in a private land (housing estate), after which a notice to keeper was sent which were ignored. Various other letters came then they stopped. Out of the blue a claim form and acting solicitors are Gladstones. Upon receipt the County court bulk centre to confirmed if it was a real claim form. AOS with full defence


So a few questions.
1. 14 days to respond, responding with AOS on day 1, so does that mean 13 days remaining to submit a defence too?
2. How likely will Gladstones go to court for a sum less than £250?
3. After sending a defence could Gladstones still go to court? and if they do will notification be sent? if notification is sent at that point could a payment be maderather than going to court?


Any help with this will be fantastic. The letter came this week.

    What is the Issue Date on your Claim Form?

    A payment can be made right up to the door of the court room.

    Are they asking £250 or thereabouts?

    If so it as considerably more than the Law allows, the solicitors know this, but hope that people will be frightened into paying by threats of CCJs, etc.

    Even if they took thus to court and won, the most a judge is likely to award is i.r.o. £175 - 200 including court fees.

    In my opinion this is tantamount to fraud and I urge you to complain strongly to their regulatory body, the SRA.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. It has even been suggested that some of these companies have links with organised crime.

    Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by in the not too distant future..
    You never know how far you can go until you go too far.

    Note that by doing the AOS it gives you s total of 28 days from the date of service of the claim to put a defence in

    Before making any payment ( not recommended!), Bear in mind that even if you lose in court you won't be made to paid £250 unless the judge agrees with their accounting!

    £175 - £200 is the ball park

    ?? Are you saying that you've Acknowledged Service (AOS) with a full defence as part of it?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I received a ticket on private land, whilst parked outside of 'my own' (my father's house) garage.  I was charging the electric car and there was a cable sticking out of it. I park at the rear where there is a garage because at the front of the house the cable would stretch across two pavements to get to the car so it isn't safe.  I received two tickets because whilst I was debating with the management company the folly of them stopping me charging a car I decided to charge again and got a second ticket. I have appealed to  Independent Appeals Service (IAS) who expressed sympathy with the matter but rejected the appeal as there is signage on the private car park.  Obviously I could clear out a garage and try and charge the vehicle inside there however if I am like anyone else the garage is full or semi full of stuff and it isn't an effective use of space.  Any advise? I have been told I could pay and then issue a small claim against the parking company and see how that goes.  It is grossly unfair to get a ticket for charging your car outside of your own garage. It is wrong and against the industry and government take up of electric charging. Please advise if you have any good ideas £200 is no small amount to let go for nothingness. Thank you for reading.
