BW Legal - Final Notice - Transfer of ticket

    Ok I have already confirm my address old and new to Napier and supplied the ticket number but that reply is what they sent me but I will try again. Could you advise me on this, should I send an email to BW Legal saying.

    I have sent your client Napier Parking Ltd a Subject access request (SAR) which can take up 30 days and I require a restriction of data processing and the case should be put 'on hold'. While I await my (SAR). I confirm my address is ............….…. and my previous address was .......................

    I googled a restriction of data and don't really understand using it in this context and what it will achieve, as it seems it is saying they have to remove my data which they are not likely to do.

    Then warn Napier that you have provided such info to identify you and that they have 30 days to respond or you will report them to the ICO ..... Don't play games with these idiots.

    Let's see if BWLegal actually understands what you are saying

  • I contacted Napier about the SAR and confirmed the basic information as in what was previously discussed and what was really needed to be provide.

    This is their reply,
    Despite the fact that we have had other communications with you via both the geographical address and email address previously supplied, when we are providing personal data in response to a data subject access request, particularly an ‘all information’ access request, we do believe that confirming the identity of the applicant as the data subject prior to the delivery of that information is an appropriate and proportionate way to proceed.

    We look forward to hearing from you accordingly. Alternatively if the ID information requested is not provided your file will be closed.

    I also asked for the case to be put on hold with BW Legal while I await the SAR but they actually said they can not do this unless Napier tell them to.

    So what is my next step should I reply to BW Legal with the reason why I am not paying the debt as that is what I need to do by the start of January.

    They can ask for ID so provide some to get the information requested in the SAR.
  • Ok I will do that but it seems unfair that they are asking for either a passport or driving license it's a bit excessive. Then BW Legal is asking for a reason why I feel I don't owe the fine in the letter before court. Is that something I just write myself and it doesn't need to have all the legal stuff in yet?

    The only ID you need to send is your vehicle's V5C. Never send anyone your passport or driving licence - not even copies. Ever heard of identity theft? Did you know that some PPCs employ former criminals?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Ok I will send them the V5C and see if that is enough, I wasn't really happy in sending then, my passport or drivers licence but couldn't really think of an alternative as kind of hit a brick wall with them.

  • If I don't get the SAR and the deadline for the Letter of Claim is approaching what should I do, I have been told not to fill out the forms supplied by BW Legal and just reply in a letter that basically says I do not owe this fine and explain why, is that correct.
