I have just received my Letter of Claim today, 5th of December though dated the end of November and I need to send a response or payment just after the start of January. I have to admit I didn't request a SAR as when I read up further I needed to request it from Napier Parking and they requested lots of financial and personal information before they would provide it, which I wasn't sure if I should give them as it was a automated form.
Should I complete the reply form provided from BW Legal which basically will be Section 1, Box D - I dispute the debt because... I had a valid ticket - (Explain on a separate piece of paper why you dispute the debt) Now go to section 4 - What documents are you sending with this form? What information do you need?
Box H I have provide documents....
Box I I need more documents or information.....
Which documents should I request or send if any.
Is there a chance that it may not go to court and they are still just trying their luck?

No and no are the answers to your questions.
Do the SAR to Napier as advised (there was a reason to get the images and letters asap). You will need that data and you need to ask now, getting close the Christmas when PPC offices will be shut.
If they are asking for too much ID info, read the post by sparky_xx I think his username is, about why a PPC can't ask for all that jazz.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok so I emailed Napier asking for the SAR as advised and didn't fill out the automated form they requested but emailed directly. I am now following through the stages on the newbies post and it suggests to send an email to BW Legal saying.
I have sent your client Napier Parking Ltd a Subject access request (SAR) which can take up 30 days and I require a restriction of data processing and the case should be put 'on hold'. While I await my (SAR). I confirm my address is ............….…. and my previous address was .......................
I googled a restriction of data and don't really understand using it in this context and what it will achieve, as it seems it is saying they have to remove my data which they are not likely to do.

Napier have replied saying If you do not wish to complete the form, we still require two forms of ID from you as detailed in Section 3. Once we have received these we can return the information you have requested within the period prescribed. These forms of ID are essential in order to progress your request.
Section 3
Proof of Identity Passport, photo driving licence, national identity card, birth certificate
Proof of Address Utility bill, bank statement, credit card statement (no more than 3 months old); current driving licence; current TV licence; local authority tax bill, HMRC tax document (no more than 1 year old).
I don't want to send them any of those things.0 -

They do need to confirm you are that person but not in the manner they say. You really cannot be giving scammers personal info
*Ticket number
*Name and address as per the info they got from the DVLA
That's it .... no phone number
If they fail to respond within 30 days, you report Napier to the ICO

It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.
All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0 -
Ok I have already confirm my address old and new to Napier and supplied the ticket number but that reply is what they sent me but I will try again. Could you advise me on this, should I send an email to BW Legal saying.

I am going through the exact same process. I keep asking BW Legal for evidence that a ticket was transferred. Initially they sent me a picture of my car and the parking sign. I replied this wasn’t evidence. Then they replied and said they had a witness statement from the parking attendant. I asked for a copy of this. They replied that it would be adduced in court.
They have now sent me a second letter before claim. I replied asking for a copy of the PAs witness statement. I am yet to receive a reply.0 -
