Faulty product 4months old - now being sold at higher amount at Amazon - wont replace?

Good morning.


I've been trying to research this online but can't seem to find a clear answer.


Back in July I bought a Logitech Bluetooth speaker during Amazon Prime Day for £129. I really like the speaker and want a replacement. Last week it stopped working so I called Amazon and they are being quite difficult and don't seem to want to replace the speaker as its now being sold for £175. And I don't want a refund as it won't be enough to buy the speaker again.


What they have done is pushed me to contact Logitech directly as the manufacturer to have it repaired or replaced.


Does anyone have any advice or suggestions? I always thought (perhaps wrongly) that my contract is with Amazon the seller who have the responsibility to repair or replace the item?

    The seller has the right to refund, repair or replace the item. They get to chose which option they prefer. It is often quicker for you to contact the manufacturer yourself, but the legal responsibility lies with Amazon.

    Yes, that is the legal position. You can force Amazon to provide you with a remedy per your legal rights. Such a remedy can be a repair, replacement or refund (full refund within 6 months from purchase). You can request a specific remedy but the seller can reject it if it is disproportionately costly. In this case:

    1) They seem unwilling to repair, other than directing you to the manufacturer
    2) They seem unwilling to replace as the price of the goods have increased
    3) They seem willing to refund

    Option 3 they are legally allowed to provide as a remedy ... the fact that the amount wouldn't be sufficient to allow you to purchase the same item again is not their problem.

    However ... Black Friday is less than 2 weeks away - you may find the same item is available with a "huge discount" that day, reduced from £175 to £129. ;)
  • It's very likely that Amazon cannot replace the item because they no longer have it in stock. The higher price item is probably being sold by a third party using the Amazon platform. Obviously, Amazon can't force that third party to replace a faulty item they didn't sell..

    O/P - can we have a link to the item in question and we can see what the seller type is for you?

    Amazons Black Friday sale will be on soon so I wouldn't be surprised if the same speaker goes on offer again.

    As a new user I'm not allowed to post links on the site - but its still being sold under the same link I bought before - Prime delivery as well.


    Given the advice I reckon the likely outcome from Amazon if I push them will just end up refunding £129. Black Friday might be my chance to re-buy but it still might cost me more.


    I'm trying Logitech directly - they have taken my warranty request and just waiting to here what the next steps might be. A straight swap would be best - fingers crossed.

    Logitech will likely replace direct as they will usually have some stocks for RMA's (even if only at their European distribution centre), and they do tend to be very good with returns.
    If they don't have it available any longer what they have been known to do is replace with an updated version.

    Prime delivery is available from several third party sellers. This is referred to as "fulfilled by Amazon", but not sold by Amazon.
    The link will be the same, but the seller now different.
