Highview parking charge notice borehamwood lidl

Hi all,
After reading NEWBIES and noticed so much information regarding appeal I was not sure if I am still able to appeal or even should ?
So I hope for quick advice from more experienced users if there is anything that can be done now... and I would try to take it from there.
The Keeper received Highview Parking Charge notice actually more than two of them where two are exactly same stay time, entry and leaving times but on two different days, which is very weird and not aware of parking on both of these days.
On two occasions there was overstay of around 19min the third one seemed to be kind of duplicate due to the fact of identical times.
Also maybe worth to mention that two of Charge Notices where issued on 13th day from the entry date, so I was not able to get them within 14 days (if that matters in this case)
Unfortunately it happened in Sept and Oct so it is already over 30 days since it happened.
Received Charge notice Reminders already, there was no contact with Highview Parking yet, should contact them to arrange payment or there is still hope to void at least the bogus one?

Many thanks and have a good day!

What happened when you complained to the Lidl store manager or CEO?

That's always the first thing to do.

Send the appeal template from the NEWBIES, even if you are outside the appeal window, for each PCN that you have received.

  • Hi thanks for your reply.

I haven't done much about it due to other bills pilled up and got overwhelmed with the situation parking tickets went to the end of the que, so my bad for postponing it so long.
I didn't check it up with any of the managers yet as not sure how to tackle it, it is retail park with quite few shops which I'm using frequently and the fact of multiple tickets I thought it will not success.
Should I use template for all of them even charge reminder was received and I'm suspecting one to be bogus?

Of course you shold appeal, it costs them money and, if it gets to court, impresses the judge.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. It has even been suggested that some of these companies have links with organised crime.

Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by in the not too distant future.

Send the NEWBIES FAQ sticky, post #1 initial appeal template (separate one for each ticket) in the hope that Highview won't spot you've missed their deadline. HV almost always cancel when they receive a (in time) forum template appeal.

Don't build up any false hopes, they may well tell you it's too late to appeal - in which case you just have to ride this out, there's no need to panic and pay them.

They have 6 years to pursue you through the courts, the good news is that HV are probably the least likely of any PPC to do so (based on current behaviour - but we can't guarantee what might happen between now and late 2024).

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

You can stop counting days; there is no need with Highview, as they don't use the POFA anyway (regardless of date on the NTK, they cannot hold a keeper liable). Therefore you are never liable unless someone tells them who was driving...like victims do in bad appeals.
Unfortunately it happened in Sept and Oct so it is already over 30 days since it happened.
I agree with the others, right now, tonight, submit the NEWBIES thread template appeal to Highview for each PCN online - NOT TICKING THE OPTION 'I WAS THE DRIVER' (OBVIOUSLY NOT!)*.

Highview won't pursue it anyway but you can;t be sure of that for six years, things change. So try to kill it off with the template appeal even though it's late. No delaying, do it now.

  • Dear all thanks for your advices!
Is this is a template we are talking about ?

    Re PCN number:

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement. There will be no admissions as to who was driving and no assumptions can be drawn.

Since your PCN is a vague template, I require all photos taken, a clear image of the signage and an explanation of the allegation (e.g. if you have identified a wrong VRN input at a machine, say so, and explain why your Data Protection Officer has not simply rectified it, rather than trying to punish a driver for a matter where there is nothing to deter).

I will be making a formal complaint about your predatory conduct to your client landowner and to my MP, appraising all parties of the debate where Parliament agreed: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists...should not have to put up with this''. Firms of your ilk were unanimously condemned as operating an 'outrageous scam' (Hansard 2.2.18). The BPA & IPC were heavily criticised; hardly surprising for an industry where so-called AOS members admit to letting victims 'futilely go through the motions' of appeal and that 'we make it up most of the time' (BBC Watchdog).

    Formal note:
Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service.
    Yours faithfully,

If that is not correct one there is anyone could reply with link to this thread or template I am bit lost on this forum, just joined it today and still have a difficulties with navigation...

    Yes.

    It's the only template appeal!

No need to seek confirmation of advice in the FAQ

    It's bang up to date
  • Thanks once again.

Only thing I forgot to mention that all the notices were with photos of entry and exit from the parking, does it matter ?

Assuming that you are appealing as keeper then you obviously give the keeper details
