nobody on here has advised anyone to IGNORE an NTK or a PCN since march 2013 , which is around the time I started coming here and advising people, not for England and Wales
we DO tell people to IGNORE for Scotland and Northern Ireland as they have different laws
we DO tell people to IGNORE debt collector letters completely
we DO tell people to REPLY To any formal LBC or an MCOL
IF YOUR LBC HAS THE 30 DAY WARNING AND HAS FINANCIAL FORMS TO FILL IN, THEN YOU NEED TO READ RECENT LBC REBUTTALS AND ADAPT ONE to send back if you intend to fight this charge
you can add that extra paragraph about the EA2010 etc to any rebuttal letter if you wish to do so, because you may wish to put them on notice about the EA2010, whereas at the moment they (like you) , know nothing about it because you have not told them yet
you reply to their LBC in any manner that they tell you to do so, be it email, or a letter in the post, or whatever, you have their letter, so do what they say, also checking what others have done on here at this same point with their rebuttals
ie:- do what all the others have done, you are not the first and wont be the last
if you wish to stop this in its tracks, only then do you pay it, that is your choice
so its pay in full or fight (although negotiating a lower figure than £160 may, repeat MAY work) - but I doubt it
what you do is your choice to make, we can only advise you on the options and where you have gone wrong thus far , hoping that you will do more research for the future, because its likely you will receive more pcn,s as these companies are everywhere now0 -

You are advised correctly to ignore debt collectors
But a NTK is NOT a debt collector letter
Realise this is highly likely to result in a claim, so start reading up on how to deal with a claim in the FAQ, #20 -
Not the case at all, on here! We have not told anyone to ignore a BPA member PCN since early 2013, over five years ago. OK.I don't actually have my son at home anymore, he has been in supported living for years now so I haven't been his carer as such so I hold my hands up to not acting sooner.

Whichever you like, as long as you get proof and don't use Recorded/Special delivery. Why do people ask how to send things when it can be done by email? Ask in writing, for what you need to see...and say why you are not liable. That's all you need to do.Do I just send an email to BWL explaining the EA2010 as you pointed out ? Do I write a letter and post it?
Please just read other replies I've made about responding to LBCs. This is simple and if you are in a tizz at this 'reply to a letter' easy stage how will you manage to defend it when they sue you before Christmas when you are (presumably) busier?

The letter states they require payment in full within 16 days from the date of this letter. Or reasons for non-payment. Failure to do either will result in them seeking their clients instructions to commence legal proceedings.....0

I have received the LBC which states i have 30 days to respond. I have responded to the previous letter by email stating mitigating circumstances (disabled person in the car and quoted the EA2010. ) which they have declined.
I've trawled the Newbies thread and am unsure how to respond. I was going to fill in the reply forms and tick the box that says I owe some of the debt but not all of it, £2.50 for the hour overstayed ( only overstayed half an hour) your advice is don't use the reply forms. Also why do they need to know household income and expenditure? Do I have to fill this in? Should I apply for SAR ? I have photographic evidence of my reg on the initial NTK and I can't dispute that we overstayed by half an hour.
Please advise. I have til 26th December to respond0 -
I would do the SAR to the PPC themselves (to NCP) and issue an LBC rebuttal to B W LEGAL
I would not fill in their forms either, too nosey and none of their business0 -
Thank you Redx. How would you suggest I write the rebuttal letter? Is there a template to use or just put in my own words? Send by email or on their online account (which I haven't accessed, I've only e-mailed them)?0
