Claiming against restaurant for overcharging?
Comments
-
Loose change says it all tbh, it's worthless and not a battle worth fighting without making yourself look petty.0
-
why are you reluctant to say how much the overcharge is.
the easiest thing to do is go back to the restaurant with the bill and ask for the refund there and then0 -
Holding on to all this anger is costing you more than the unknown amount of "loose change" involved. I suggest letting go of it, not returning to the restaurant and making sure others in the locality know. That'll cost them more in the long run.
AFAIAA there is no minimum amount to claim for, but you might not automatically get your costs back, that might be likely if the court thinks your case is wasting its time0 -
Oh good grief - is anybody really taking this seriously?0
-
They might not be able to sue due to De Minimis rules.
If I'd seen this last night I would have said exactly the same. For a "loose change" amount this rule would almost certainly apply, and you may even lose your claim filing fee.
MCOL costs are (from memory) £25 filing and (for less than £300 claim value) £25 hearing fee (if it gets that far).
As others have said, some battles are not worth fighting. But by all means explore Social Media and Review Site routes if that'll help you deal with it.0 -
If there was a minimum amount you can claim for then i'm sure someone would've mentioned it by now. As they haven't i can only guess there isn't? Which to me means they're only asking the amount to jeer a little longer. I know that this post will encourage them more but still, as you actually helped, that's why.
Anything less than £100 runs the risk of being rejected so take that as your minimum.0 -
I sort my bill out on the night, then I can sleep my wobbleades off and not worry about it. If the place as carp, I do not return!0

OP just sent me a PM to say the overcharge was 7 pence.0

Have already answered that one.why are you reluctant to say how much the overcharge is.
It would be very easy in a way yes, but also very expensive since it's about 200 miles away. I believe there's a few in the country but not many. I think it originated in Germany if i remember reading right.the easiest thing to do is go back to the restaurant with the bill and ask for the refund there and then
If it's likely to get thrown out then i'll have to leave it. If i was guaranteed a win then i'd have done it but if this isn't a sure thing despite a receipt and bill saying i'm in the right then i'll have to leave it and as you say hit social media. As others have said, some battles are not worth fighting. But by all means explore Social Media and Review Site routes if that'll help you deal with it.
People say this is 'costing me'. No, i get satisfaction out of doing something so to me it's worthwhile. It would 'cost me' to do nothing and let it go because i wouldn't be happy with myself for letting it go.
I'll give you 7 pence to prove itOP just sent me a PM to say the overcharge was 7 pence.
