    Poppy I have been a Motobility customer since 2013.
    After I lost my husband suddenly in 2010 I bought my daughter a second hand car ( as she was my carer ) but the cost of insurance and putting right MOT issues etc made it too expensive to run in the end, so when I was reassessed for DLA and was awarded high rate mobility I applied to Motobility, as everything is taken care of with the monthly payment.
    My daughter is the registered driver, and as my carer, uses it for shopping, taking me out and getting me to appointments etc.

    Hi Calcotti, I telephoned the DWP to enquire as to whether the back-payments were going to be sent directly to Motobility, but she said, no the payment is coming to me.
    They are starting payments to Motobility from 31st October and I should speak to Motobility about the period that they haven’t been paying, ie the 12 weeks.
    I phoned Motobility yesterday and the advisor was a bit vague, as though he himself wasn’t sure, and he just said, it would take 2 months or so for everything to settle down so to just hold onto the back-pay when I receive it, so I can pay it to them and I would have to make payments towards the difference once it was worked out.
    As I said, he sounded vague so I felt I still didn’t know what was going to happen, so came on here to see if anyone had be n in this situation, which surely some people have, just not someone on the forum.

    The issue arises because now the OP has had their award reinstated they want to keep the car so it’s not being returned - at least that’s how I read it. I guess Motability may be saying that the early termination of the lease under these provisions hasn’t occurred and OP should make the payments. However that’s why I asked OP to clarify whether it is Motability who have “pointed out” that OP will will have to make these payments. If it’s somebody else they may be wrong.

    In your position I would re-contact Motability and if necessary ask to speak with a manager to give you the correct advice, or use the 'live chat' facility so you can save a hard copy of their advice:

    Early 2017 my motability car was returned after 6 weeks or so, after being refused high rate mobility component of PIP.
    I was successful at MR stage, but I had purchased my own car by then.
    I had had that car for a year or so, when I decided to return to motability.
    Days after ordering my new motability car, I received a letter from motability telling me that I could not proceed with them until I had paid them £170.
    I don’t remember this being explained to me when I phoned motability to return the old car.
    I just didn’t expect it and it came as a big surprise.

    Peter, this I have already done, sent an email to Scope to see if they have any answer to this.

    I think it would be a good idea to phone Motability again and ask someone in a senior position to clarify this once and for all as it is such a grey area, as my PIP enhanced mobility was reinstated during the 26 weeks, so I’m stuck in a bit of a no mans land.

    Thank you again everyone for your input and redirecting me to other cases or someone who may be able to help.
    It is really appreciated.

    NB: for those not aware of how this came about:
    I was refused enhanced mobility, asked for MR, refused again, started appeal, during which time I received the bundle of paperwork, read through the paperwork page by page, and stumbled across the fact that the Atos assessor had written, is able to walk I metre but no more than 20 metres aided or unaided ...it was there in black and white.
    Sent a letter to the tribunal, pointing this out, and then received the letter from DWP backing down.

    It seems from the post you directed me to, the claimant had exactly this same situation.
    It does seem unfair that we have to go around the houses to find out what happens in our situation, but many thanks for pointing this out to me.

    This is my point, nowhere on the letter I received from Motability did it state that I would be expected to repay the missed payments during those 26 weeks during appeal, if my appeal was upheld.
    I believe this to be a major omission on their part, as you are already in a distressed state and not thinking straight and as I said previously, I assumed this was just part of their new transitional scheme.
    I would imagine by now they are aware of this omission of information, but the advisor I spoke to seemed very vague as to how things worked in my case.
