argos refusing replacement

Wondering if someone can advise me please ...have a tassimo maker that 23 months old and is now faulty ..it has a 2 year manufacturers guarantee argos have refused to replace the item saying i have to take it up with bosch the maker or tassimo...i tried telling them that my contract of sale is with them didnt help at all so i am stuck with a item with the guarentee fast running out

    What does the manufacturers guarantee state?
  • The guarantee is nothing to do with Argos - it's with the manufacturer. If you want to use your consumer rights, you will need to prove via a report that the coffee maker has a manufacturing defect that was most likely there from the start. Argos also have the right to repair or replace it if they accept the report you get.

    Why haven't you contacted Bosch? I'm sure they will be helpful.

    Argos are right, the warranty is not a consumer right so if you want it fixed send it to the manufacturer.


    If you want your consumer rights then you need to go to all the trouble of proving the fault is due to an inherent fault present at time of purchase. You need an experts report for that. Its all down to you now (after 6 months) to prove have consumer rights.


    Why don't you want to let the warranty deal with it?

    it wasnt that i wouldnt approach bosch i sent them a email too havent heard back but i started with argos because of whats write on this site ...

    When returning items, beware shops trying the oldest trick in the book: saying they're not responsible for the shoddy goods and you must call the manufacturer. This is total nonsense!

    If a company fobs you off by saying "go to the maker instead", it's wrong. It's the retailer's job to sort it.

    It doesn't matter if it's an iPod from a high street shop or a designer frock from a department store. If something's broken, torn, ripped or faulty, the seller has a legal duty to put it right as your contract is with it.

    also like to note i didnt ask for a refund i wanted the item replaced

    If I were you I'd be activating the Bosch 24 month warranty NOW!


    Whilst it's true that your consumer legal rights lie against the retailer, after 24 months you may be hard pressed to prove that it was faulty when you bought it. In any case, after 6 months you would need to get an independent report establishing that it had an inherent fault at the time of purchase.


    So after 24 months it's going to be simpler and quicker to go direct to Bosch.


    PS - this is a recurring theme on these boards. If you want the retailer to deal with a piece of kit like this they almost certainly won't have the expertise to identify any faults. They will simply forward it to the manufacturer, the manufacturer will reply to them and then the retailer will forward the reply to you. (EDIT: and at the outset you will have had to go the time and trouble of getting an independent reporting stating the fault was "inherent"). Going direct to the manufacturer cuts out the middle-man. For simple, non-technical purchases, its probably easier to assert your consumer rights aginst the retailer.

    It helps to understand your rights before you quote them.

    Did you provide Argos with a written report stating that it was faulty due to something which was wrong with the machine at the time you bought it even if it wasn't showing as a fault? No? Then Argos are perfectly in their rights to not repair, replace or refund.

    As above, it will be much quicker and probably a lot easier to just go to the manufacturer.
